Travel while waiting for GC

Hello! 

 

Husband got his I-797 Approval Notice for I-485 application to register perm residence or adjust status. 

 

Can he use this for international travel? Or must he wait for AP or GC to travel?

Timeline

Is the travel urgent?  Once you get your approval notice, the GC typically arrives pretty quickly.

Thank you! Yes we’re actually hoping to gather the documentation to request an expedite for health concerns with his daughter but by the time we get the documentation needed from Cuba it may be the same as waiting for the GC to arrive! How long would you say? A couple weeks?

An I-797 is not a re-entry document. He can now (since approval) travel only with his Green card or an I-551  stamp in his passport.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Well we did our interview, biometrics and all already now we just got “I-797 | NOTICE OF ACTION” 

Notice Type: approval notice

No - he must wait for GC or AP.  You can try the expedite.

This is a known drawback when coming in on a K1.

Technically, if AOS was approved then re-entry shouldn't be an issue as long as one can provide proper identification documents (i.e. a passport). However, getting on board a flight would be very difficult, timely, and costly at best without proper documentation to board the flight.

There's also the very real risk that the case will be reopened for reconsideration before the GC is issued. My friend recently had this happen....approval in February (not just at the interview...actual official notice), reopened shortly afterwards, and the GC arrived just this week.

Maybe I misunderstood the original post. I thought the AOS application was approved and they have the approval notice. No? Typically the GC arrives within a week from the paper approval notice arriving in the mail. If I got the wrong end of this, I apologize. I certainly don't want to give inaccurate advice.

If they were approved, that is great, but that was really quick :)

 

They need either AP or GC. No way around it.  I can't find anyplace that says she can get a I-551 stamp with an approval letter.
