My guess is the cosponsor, as a 864 can be enforceable where the 134 is not.

An I-864 is only supposed to be used for immigrant visa cases. It explicitly states this on the I-864:

"If you sign Form I-864 on behalf of any person (called the intending immigrant) who is applying for an immigrant visa or for adjustment of status to a lawful permanent resident, and that intending immigrant submits Form I-864 to the U.S. Government with his or her application for an immigrant visa or adjustment of status, under INA section 213A, these actions create a contract between you and the U.S. Government. The intending immigrant becoming a lawful permanent resident is the consideration for the contract"

 

Personally, I would inquire with the embassy to confirm again (noting that it says I-134 on their own guide). If they still want an I-864, I would just furnish that and get it over with. It's not a mound worth dying on.

Yes. 100% for I-134, but for AOS the I-864 is 125%, which again makes no sense really to just not require 125% from the start.

I could never find the requirement for the I-134 online but always find the I-864. Then people kept saying it was the same thing So thanks you.

I would contact the embassy and say:

 

I need clarification on a 221(g) received at my K1 Fiancé interview on June 20, 2019. It is marked and circled to submit Forms I-864 instead of the I-134s which I submitted from both my fiancé and a co-sponsor. Your K1 instructions say "K and Diversity visa applicants are not required to provide an I-864 Form." The 9 FAM 302.8-2(B)(2)(f)(3) says a K1 fiancé is not authorized to use Form I-864 and should provide Form I-134, which I did provide.

Question: Why am I asked in a 221(g) to provide an I-864 for my K1 Nonimmigrant visa?  Is that a mistake or a new requirement?

Last question ive just checked the ceac site to see what it says and it says for me I’m in administrative processing but for my 2 k2s it says ready. Is this normal?

Yes. The status input for London on CEAC will not give you any specific clues as to what is going on. Ignore it until it says "Issued" is my best advice. Otherwise you are just creating puzzles in your head.

There are only 2 statuses you need to know - 'issued' and 'not issued'. Unless it says 'issued' it is 'not issued', regardless of terminology used by CEAC (ready, administrative processing, etc). You can only travel with an 'issued' visa so that's all that matters. Until it says 'issued' you have no visa. Ignore the random stages it goes through to get to that stage.

I too received the 221g the embassy in Jamaica did this to me as well.  Requested the I864 from a co sponsor.  I secured a co sponsor and had them fill out the  I134 with no issue.

I would just go ahead and inquire and start getting the I864 forms filled out, they’re a little longer than the I-134.
