Interview today. More evidence requested

So I’ve had my interview today and we’ve been issues with a 221g and request for more info.  

Back story.  My fiancé was made redundant out of the blue, and so we had his dad also fill out a affidavit of support also to co sponsor. 

The interviewer says one of them filled out the wrong affidavit of support form.  Is there different ones for a co sponsor? They’ve also asked for a IRS Transcript even though the joint sponsor provided w2s.

I'm going to restart by saying THIS is why people need to give basic advice (Give them advice based on what 99% of everyone else needs) instead of going into the past history of the consulate and telling you to "just don't worry about London, they won't even ask for a cosponsor" and "they won't even ask for the I-134", which is what was told to you in one of your prior threads.


First, what form did they fill out? I-134 or I-864? For K-1 you use I-134 form.

Second, W2's alone are not enough. You need W2's -AND- your tax return/schedules, so W2 and IRS form 1040. W2's aren't enough and they don't show taxes were filed. Tax transcripts are the best option for anyone.

What exactly have they asked for on the 221g?

They both filled out the 1-134. They’ve requested I-184, I-864EZ or I-864w but not said which one or who needs to fill that in. The petitioner or the co sponsor.  Id upload a photo but it’s saying it exceeds the limit for uploading.

OK. Please clarify for my simple brain.  You are saying that for a K-1, London is asking for an I-864, correct?

That is strange and I would question it. You may be able to send an e-mail to the consulate or call and find out if this is correct.

If it is, then that's a big confusing first time jump that I don't think we've ever seen here before. I don't think you can have two existing I-864's, it would be like having two contracts, one would invalidate the other. Unless they know this and it's going to be a new process to I-864 K-1 and then invalidate it and do a new I-864 for AOS...??

I-864 has been traditionally tied to a green card. Maybe it's possible that they want a contract before an intending immigrant even comes into the country? This also would balance out the issue of I-134 needing 100% poverty line and I-864 needing 125%...

@geowrian @Boiler any ideas?

I would assume they are asking for an I-864 from both and tax transcripts for both.

I mean I'm not going to lie, it makes sense and I support it in a way, but it's new and unexpected.

I have piggyback on @Ash remarks that every embassy is different in their requirements and basically what they ask. 99% of the time the cosponsor completea the I-134 but I have heard that another embassy does the same as yours, by asking for the I-864. Your cosponsor completes the I-864 and not the others.

 

The information below is what the embassy's are asking for in the way of financials. 

 

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form (https://www.uscis.gov/i-134) K1/K2 Interview Preparation Instructions – English (February 2014)  Page 3 of 9 with an original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Get the IRS transcript in place of the actual 1040 here: https://www.irs.gov/Individuals/Get-Transcript Use this link to determine the income levels needed https://www.uscis.gov/i-864p.

Wouldn't be a bad idea to just get rid of the I-134. Never made much sense for the 100% requirement only then to go up to 125% with the I-864 anyways. Who knows, maybe just embassy specific, but wouldn't be too bad of an idea.

could they be requesting the I-864 as I have 2 K2s also? 

My minds absolutely blown atm. Do you suggest having the co sponsor fill out the i-864 instead of the petitioner then? 

We did have plenty of proof of cosponsors income at the interview.  The first window actually said she didn’t need paystubs etc as w2 and letter from employer was sufficient.

Yep.  The I-134 is similar to a fiance's letter of intent........shows good faith at the time, but not legally enforceable....
