Intent to dent k1 visa walsh act

I got almost denied k1 visa intent to deny i have lawyer 

Pyscholgist

Theeapist

Counselor what else can i do to over come this

Im not even a sex offender how can they  put walsh act 

Any suggestions

You are going to have to be a lot more specific than that if you want help from members.

Something in your past put you into that category and you know it as you already did the Therapist,  Psychologist, counselor and lawyer route. My best guess is let the lawyer handle it.

I  was 18 she was 13 we had relationship i orginally got charged with felony but got dropped down to misdemeanor delquency minor no offender list no proabtion just jail time that was 5 years ago

More details are needed - especially regarding any past criminal history (conviction or otherwise).

If the lawyer seems to be addressing the case, then listen to them. If you are doubting their decisions, ask another and/or provide details as to why you are doubting their decisions.

 

Overcoming AWA restrictions is incredibly difficult and typically takes several years at best.

 

Edit: I just saw the couple details posted above...

USCIS uses the AWA criteria as written, not just the criminal disposition. The fact that it was dropped down to a misdemeaner may be a factor but USCIS is not bound to those charges and can consider the individual merits of the case.

Essentially, you need to either:

1) Show that you do not fall under AWA. This is a burden placed on you, not USCIS to show otherwise.

2) Overcome the AWA restriction with a waiver.

We understand your confusion and frustration in a sense, but there are reasons this is in place, protecting the potential incoming immigrant is one. They will have to obviously be told all details about this 'issue', if you manage to get pass USCIS, it probably would come up during the interview as the CO will want to make sure the fiance is fully aware.

Could have been 20 yrs ago...it still remains on your record. I can't stress enough how everything one does is documented somewhere for crucial retrieval!

 

Question, is, although it was knocked down to a misdemeanor, what country did this take place? Possibly, age 13yrs was not old enough to consent where the original felony was charged.

Which state? Some states have the “Romeo and Juliet” law big I would assume the lawyer would/should be dealing with this and guiding you.
