Staring Law School After K1 Interview

I hope someone can help me with this! I've looked for info everywhere but can't find it.  My fiance (petitioner) earned enough to qualify as the primary sponsor for my K1. However, he will be starting law school around the time of our interview (will not be earning). Do we need a cosponsor? We will be going through the Montreal embassy in Canada.

 

Any help is appreciated!

At the time of the interview, his current income will be zero....and will not qualify to financially support you.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you for the response. How do we go about having a co-sponsor? Will they fill out a separate I-134?

You need cosponsor for the I-134 and a joint sponsor for the I-864 during the AOS

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

That's the million dollar question.  If I were packing my bags to leave my country for another country I've never been too and have no support I think I'd say hold up there buddy we have to talk!

Sadly, the financial aspects of immigration seem to be an after-thought these days......and thus there is more consideration of the public charge issue by consulate officers......imo.

you will need a cosponsor if he is not working

 

and if he is not working, who is paying for life? you CANT work. hes NOT working. both for your k1 and then AOS you have to have steady income. who is buying the groceries and paying the light bill? health insurance? rent? the AOS fees?

 

im all for school and furthering ones education but right now might not be the best time to do it....

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

 

ROC

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

Thanks everyone! I really appreciate the concern. We actually have thought a lot about the financial aspects of immigration. We have a large amount in savings, scholarships, generous family support, and a clear budget for what comes next. The goal of this question was to gain clarity on the legal side of things.
