Im so confused to what forms to file. Some people say just file I-130 and some say I-130 plus other forms like I-145,I-485,I-751. 

I just got married and just waiting for my Oath of Allegiance. What forms do I need to file to start the process of bringing my wife here?

If your wife is overseas, you start with I-130. If your wife is here in States, you can file I-130 and I-485 together. If you are going to be citizen soon, i suggest you file 130 as USC. Yes you can file now as permanent residence (F2A) and later upgrade to CR1 but if you are scheduled to be citizen within 30-60 days, i would wait to file as a citizen. If it is going to take longer to become citizen, go a head and file now. (This is my suggestion only as i filed a PR and later upgraded to CR1) 

 

Start filling I-130 (https://www.uscis.gov/sites/default/files/files/form/i-130.pdf) and gather documents such as marriage certificate, photos together, boarding passes, receipts etc. I would also suggest front loading your petition to avoid any RFE. Front loading is where you include as much as evidence of bonafide relationship.

Once you are a USC ... If you wife currently resides outside the US, you will be using the Consular Process, where she will wait out the processing time and interview in her home country... the I130 is the first step of this processing ... all that is needed is the I130, required supporting documents, and the fee 

If she is legally in the US on another visa type she may be eligible to apply for Adjustment of Status ... which requires the I130 and the AOS forms  such as the I 485 

 

As an LPR you can start for the spouse of an LPR petition now, and upgrade to the IR1 as soon as you become a USC.

Correct but the I-130 is NOT the ONLY form to be filed.  The OP needs to carefully study the I-130 instructions and the guides here, so they know what other documents and forms should be submitted for their own circumstances.

Appreciate the answers. Sorry for the lack of info. She lives overseas. The plan is after my Oath taking, I'll start filling the forms.

So I should start with only I-130? Then when she finally in the U.S... What forms should I file?

You need to understand that entering with a visitors visa into the US with the intent to stay and adjust status is visa fraud. 

You will file the I130 and all the required documents and fees. Once this is approved the NVC stage requires more firms more fees and more documents. This all happens while she remains in her home country.  The final stage is the interview for hr at the US consulate in her home country. When the visa is issued then she travels to the US and is granted entry and is the an LPR. 

The USCIS website has great information on this whole process. IR5. Go and find it read it then come back with questions

It depends on how long you've been married when she enters.  If she enters with an immigrant visa after your two year wedding anniversary, she'll just renew her green card in ten years or Naturalize before that.  Study the spouse visa guide.  Learn the process.

The first step is the I-130 packet.

Then after approval (currently ~7-11 months), it will be sent to NVC. More forms and documents are provided at this stage. NVC wiki: https://www.visajourney.com/wiki/index.php/NVC_Process

Once your case is complete at NVC, you will wait for them to schedule an interview at the consulate abroad. A medical exam will be necessary as well.

Once the interview is complete, if she is eligible for the visa they will issue it. That said, it's not uncommon to be initially refused the visa under 221(g) for additional processing, such as needing additional documents.

Once the visa is issued, she will travel to the US. If admitted by CBP, they will endorse her visa and that acts as a green card for up to 1 year. A physical card will arrive in the mail later (assuming the fee has been paid).

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date

You file the I-130, I-130A and G-1145 by mail/ courier to the Chicago Lockbox.

Thank you for all the answers! I just have a hard time understanding the answers on google.

 

So when do I file I-864 (affidavit of support)? And do I need a full time job to be approve?

Because I'm planning to change careers.

According to USCIS(https://www.uscis.gov/i-130-addresses) I should send it to Phoenix Lockbox not to Chicago. Because I reside in California and my spouse lives abroad. 

Am I right?
