Actually not really. She didn't ask me to ask about anything.

She is just going through some weird issues with her immigration journey and I'm curious about something.

 

So she and her USC husband have been living in the Germany for a while and now decided to move to the US. I don't know if they are going through the DCF or spouse visa, but that doesn't matter.

 

So they applied and USCIS apparently told them that they don't accept her husband Mexican divorce certificate. And in order to fix that, she said that USCIS told them they have to go to the US to re-marry over there and then come back to Germany to continue the process (?). I told her that I think it's weird that they can't just re-marry in the Germany?  But she is sure that she needs to go to the US just for the quick wedding, no other way.

 

So, dear VJ, I'm just curious what the hell? Is this a legit thing?

When you say divorce certificate do you mean marriage certificate?

 

I'm trying to see how remarrying in Germany is going to do anything to a Mexican divorce certificate?

 

I also have NEVER seen US marriage as a requirement for DCF or spousal visa. It’s never mattered where you were married as long as it was legal in the country that you married in.

 

who with USCIS told her this? CO? RFE from NVC? Tier 1 or 2?

I don't really follow the "re-marry in the US" part. A marriage is a marriage regardless of what country it happens in. Is it because Germany has some kind of laws that make it difficult to marry quickly?

 

Sounds like there may be some misunderstanding and miscommunication here. USCIS may be skeptical of the Mexican divorce certificate but I don't see how that would be remedied by getting re-married anywhere. Seems like if that is the problem, the solution would be to get a real divorce certificate and go from there.

 

Since we're getting all this info second hand, it seems like something is missing here. I've heard of USCIS being skeptical of non-US divorce decrees/certificates, but insisting people marry or re-marry in the US? Never heard that one. It's strange.

Yeah her husband was previously married to wife no.1  and then finalized his divorce in Mexico.

 

Uscis told her that they dont accept that document and now my friend needs to marry her husband again in the US to fix it. I think in the first place they got married in the US also and then moved to Germany. So its just... I dont know lol.

I know! That's why I was trying to get more info from her but she only says that in order to immigrate to the US she needs to remarry (in the US). 😛

She's flying to the US next month for the wedding  😛 seems like a waste of money and time to me especially since I'm 1000000% sure they could just marry in Germany.. also not sure how it works to marry someone you're already married too.

It almost seems like USCIS is bullying her.

 

 

If they feel the divorce certificate isn’t real, is there a better one they can provide.

 

I can’t wrap my mind around the idea that getting married a second time to wife #2 somehow makes divorce from wife #1 not exist or needed anymore.

Right? So if it’s not in writing what happens if she sends ANOTHER marriage certificate with a new date? Are they going to question it’s legitimacy?

Agreed. God only knows that you need them to say not keep the first divorce certificate in the system but then keep two marriage certs to one person on different dates. 

 

Wouldn’t a new date also mean he would be CR-1? Technically they would be married less than 2 years?

 

then you AOS and there’s two legal US marriages.. years apart... in the system and will they say CR-1 was obtained incorrectly? Jeez
