I am aware of that ma'am and it's so sad that those kind of people are heartless leaving their kids behind and living for pleasure in other countries, no offense of that. Thank you for the taking the time reading and commenting on my status here. It is highly appreciated. I will post for updates here for my next application. Godbless!^^

I'm sure you meant no offense, but I find your comment ironic, given the fact that you intend to leave your children behind to vacation with your boyfriend in the US.

 

I do not condone the acts of those Filipinos who chose to break US immigration laws, but I do understand that many of them did so out of desperation, for the sake of their own families who are depending on them.  It annoys me greatly that their actions have made it harder for genuine Filipino tourists to be granted visas, but I would not rush to label those Filipino illegal workers as "heartless".

My apologies, I didn't mean it. But having a vacation just to visit my boyfriend guaranteed that they are in good will since my parents will look after them and of course be back after then. And I do understand those Filipinos who works hard for their family because I am one of them.

You were likely denied because you were visiting your boyfriend in the US (a reason to possibly overstay or possible intent to immigrate), and if you did not have enough evidence of strong ties to your country, that'll do it. Having kids back in your country alone would not be strong enough evidence of ties to your country - many people will immigrate ahead of their family (spouse or children or both) to the US to become established, with intention of bringing them to the US down the road. I have 3 people who work at the company I do from the Philippines living here right now in that exact situation.

 

I'd suggest making sure you do have better proof of your ties to your country, and proof you have reason to return, should you decide to apply again.

 

Also note (since you mentioned it in another post) - if you and your boyfriend have intentions to eventually use the K1 route, you have to be fully, legally divorced (not married or separated) in order to even apply, or that will be denied also. Just be aware and research avenues well before taking them, so you don't waste any time or money. :)

I love how you react to people telling you negative yet realistic outcomes. You seem genuine, at least on what you share here. But then again, as most of us know, they don't look too much into details, only the red flags if there are any and in your situation, there are.

I suggest wait on it a while before applying again since my now husband did that and was denied twice. We applied for K1 and now we're 5 months married.

Thank you ma'am,  yes I'm a married woman but already filed annulment since last year and hopefully this month I will get my annotated marriage contract so I can apply a new passport under my maiden name already. My first application I used my married name which I knew and doubted if I can get a visa for tourists purposes. When the consular officer asked me if I already met my boyfriend yes I do since he was here last January for 3 weeks. Sometime this year I will try to apply again and give it a shot if the consular will approved my visa. There's no harm in trying again anyway, but this time hopefully there were changes under in my circumstances. Thank you so much.

I don't really have a plan to apply a K1 visa because there are many things to consider, just a B2 visa cause my boyfriend invited me to spend a vacation there for 15 to 20 days to experience and see how is America like. Any suggestions for my application next time? I really appreciate it. Thank you

As mentioned from countless others... there are many things they consider when someone applies for a B2. One, while you may be starting this program in August, that is still some time away... two, a US boyfriend.... three, you are married but getting annulment done which leaves even less ties to the Philippines... now since you were already denied, only applying a month later without any circumstances changing really, they will look at you as being desperate. It isn't about that he invited you or not, it's that you have to prove to them why you would return to the Philippines, and from things stated, doesn't sound like any real reason to.

 

Do you have any travel history at all? To any other Asian or European countries? Even for people who travel extensively, they can still be denied a US tourist visa... but it can help strengthen their case by showing that they travel and return from other places without issue.

 

The advice mainly given from others is accurate.. while it doesn't seem fair to some, it's because others before you messed it up by staying illegally in the US, so now the embassy has to be strict on standards.

I understand and fully aware of the situation sir, thank you for the advice. And to answer your question No, I never been abroad. This will be my first trip to travel outside the country since it's not my priority since then cause I have many responsibilities here especially my kids and family (I am the breadwinner) even if I can afford to travel. If I do apply again, I will make sure that there are changes in my circumstances and have a strong reason to return to my country. Thank you so much.

Before you apply for another B2 do some traveling in region.   There are plenty of places you can take short trips to nearby that do not require visas or offer visas on arrival.   Hong Kong, Taiwan, Malaysia, and even now Japan are options.

 

Still there is no guarantee to getting a B2.  As others have said it is pretty hard for a Filipina.

Not heartless nor are they "living for pleasure" - typically they either illegally work and send the money home, or they find some way to gain legal status in the US then bring the children over later.

There's a case of a Filipino on VJ that recently gained eligibility for an immigrant visa via a relative but their new child wouldn't be covered, so their plan was to come to the US then petition for the child to come so that they would "have a better life".

 

Anyway, the point is that in the vast majority of cases they aren't heartless - but it is still illegal, wrong, and makes it harder for people like you that want to just visit.

The best thing you can do - IMHO - is to travel elsewhere and build up a travel history. Pretty much everything else is not something that you can just change...ties are not something that one can easily create or change.

My apologies for using the bad word. I didn't mean it that way, I know it is hard to look for a stable job here in the Philippines when the income is low and not enough to support the family.
