The law is clear. If non-citizens (except the exempt I mentioned above) move from a U.S. address to another U.S address, then they must notify USCIS in writing (either online or by mail) within the 10 days, as per the INA.

Hi guys, 

 

I don’t know if  @Greenbaum is on this platform.  

 

so I have basically completed all the paperwork except for a few sections and my petitioner would need to file for tax returns which takes about to weeks to get. I don’t understand why it takes that long.😒

 

The question I have is with the AOS form. 

 

Now that my petitioner and I are married, will she need to apply for a change of name before filling the forms? Because the first thing on the AOS requires the name of the sponsor. We are confused whether to put her former surname since that’s what on the w2 and other financial documents or put her new surname which is on the marriage certificate. Or wait till we change her name officially before applying. 

 

Please help. Really confused. Thanks

 

PS. This question applies to all sections where my petitioner/sponsors’ name is needed on the form

Can we try biometrics walk-in if I already sent the letter out to reschedule? I figured we would just try with the copy we made of the letter. Anyone have any experience with this? We don't want the process delayed anymore.

I think it's fantastic to be able to file electronic and the check is in you account in approx 2 weeks.

The name change comes when you file the marriage after the wedding. So when you return back to your county court house and file your marriage that is when you change your name. I hope this is what you did otherwise $$$$$.

 

On any new forms you use the married name unless it request the maiden name.

Others mentioned being a walk-in was an option. We did receive a biometric appointment letter, I just sent it back to reschedule already. We will be out of town next week when it was originally scheduled.

**Update**

Feb 22 - Biometrics done. Original schedule is supposed to be on Feb 26 but tried to do walk in and luckily they allowed it. You just have to tell them your reason why you couldn’t make it on the the schedule they gave and they will decide to allow you or not.

Anytime that I have tried a walk-in with USCIS I have been turned away. So your mileage may vary.

Does anyone know if all the passport type photos required for the APS / EAD / AP need to be without glasses?

 

I have a bunch of photos with me wearing my glasses, but if it has to be without I will need to go and get more taken.

 

Does anyone have personal experience of this?

I assume you already know how deficient the instructions for the I-485 are about this:

I would not risk it. Get new photos at Walgreens, it will cost you less than $70 (they have coupons too).

 

I believe last year there was a change for all government agencies regarding federally issued IDs - no glasses, no smiling with teeth showing (that has been the rule in the EU for quite a while). I could be wrong, but the person at Walgreens also reminded me not to smile and to take my glasses off.

 

I know the whole process is expensive, but let's put it this way - are you willing to save $70 but risk getting an RFE and delaying the process by weeks, if not months?

If they are Costco members then I recommend Costco instead: https://www.costco.com/Passport%2C-Permanent-Resident-and-Citizenship-Photos.product.100142614.html The website says 2 pictures for $4.99 plus tax but at my local Costco they print 3 pictures for $4.99 plus tax.
