AOS Denied because abusive husband revoked sponsorship

Checking with anyone who may have experienced a similar situation. Abusive husband revoked sponsorship on AOS and now received denied I-485 and have 33 days to appeal. If I apply for self-petition, do I need to appeal the I-485 decision or applying under VAWA makes it unnecessary? Thanks for all the help.

You would need an I-360 for VAWA then a new I-485 as the current one is denied.

You can only appeal if you believed USCIS made an error in the denial. It's within his right to terminate the sponsorship if he so choses and USCIS was right to deny the I-485 since the relationship has been severed. Remember you were adjusting your status based on the relationship with him and if he withdraws, then the pending I-485 becomes dead under water as well. Fortunately there are also provisions within the INA that allow you to self petition as a an abused/battered spouse and that's the recourse you should take as mentioned above by geowrain.

Have you kept evidence of the abuse? Police reports? Hospital and medical reports? You will need that if you are going to file under the VAWA provisions.

So I won’t appeal. Self petition under VAWA is free. Do I pay the AOS fee when re-applying under VAWA? I am starting to get all my evidence.
