You can argue the instructions should state somewhere to NOT file the i90 if you dont have X amount of time left before it expires and if you got a NOA receipt for the i90 include it as proof it was a valid submission when you sent it in. It will probably be a headache to ask for the fees back and a lot of back and forth- but theres a chance you might be successful.

I have that thought ask for refund for a second, but my time is better spend elsewhere. ;)

I wonder, though if the 4 months or so inbetween didn't help matters...if the i-90 was filed as soon as the card was lost instead of several months later, it may have worked out to @mobilebucky's benefit.

Personally if I did not have to travel I would not pay $540 to replace a conditional green card which is valid only for another year. Better things to do with my money. You definitely can get away with it.

Who knows, we didn't look for the green card until we have a trip coming up, that is why the wait.  I am just thinking the original poster timeline is really similar to my wife one that is why I suggest he check with the local office first.

USCIS will usually only provide I-551 passport stamps to people with either a pending I-90 or I-751.

this is the answer i was looking for! 😄

 

I'm just hoping you don't have to go in and hand in the old green card or something like that. If it's only copies you need then I am good to go.

Please update us with how it goes.  Given how long it's taking to adjudicate I-751's, I wonder what happens if someone loses their card after the ROC has been submitted.

The cost can be prohibitive to some, I agree.  I always looked at my GC (when I had one) as just another form of ID, really... kind of like people carrying a drivers licence everywhere...although obviously cheaper to replace a drivers licence (presumably the same amount of hassle!).  Honestly, it felt a bit weird for me the first day I *didn't* have to carry a GC on me anymore...I'd gotten so used to it, having it so long.

I felt the same way that's why I got the passport card now :D

Why do they make you carry it everywhere with you and then make it cost $500 to replace? 😭

I'm glad you have copies of the front and back. It will make filing for ROC much easier.

You know, I *almost* did that, too, just to have some sort of card to carry around.  For about a week before my oath ceremony I was nagging my husband all the time "but when I was a LPR I had to carry this card around with me---how do I prove I'm a citizen????!!!"  lol  Probably didn't help matters that I regularly frequented a profiled area in Queens where ICE had done a few, shall we say, "spot checks" in the past, so my temporary paranoia was running high.

You CAN NOT get a 551 stamp when you lost your GC with out showing you filed a i90. 

 

It becomes more difficult when you filed for ROC because stamps for proof of status are only given if the combo of NOA+expired card is close to expiring. With out having the card I dont think they will give a stamp. USCIS has policies to prevent people from opting to not pay for a replacement card and get a free stamp instead/

For filing ROC a copy of the card is all thats needed but keep in mind the NOA extends status when presented with the expired card...

Right, but isn't there a Catch-22 that arises?  If you're in ROC, your current green card is expired.  If you file an I-90, you're asking them to reissue an expired green card--I can't imagine they would do that.  So they can't stamp your passport without the physical green card, and they can't reissue it because it's expired?  

 

I only ask because there was a period of time where I contemplated finding a way to permanently attach my husband's wallet, keys, and mobile phone to his body because of his tendency to lose them. :)

Your Green Card is evidence of your legal status whether it is expired or not......I think they should send a duplicate expired card....but I don't make the rules...😁

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yup it sure does seem like a catch 22. 

I dont think they will issue a replacement card IF your card is expired but at the same time they wont give you a stamp unless you show you paid the i90 fee... So for people in that situation..IDK? They can try to go to infopass for a stamp and argue they are not eligible to file the i90 since its for an expired card and maybe they will give them a stamp but I believe that they will insist you file (and pay) for the i90 and show them the NOA to get a stamp. I believe when you file for an expired card you get the NOA and then later its denied vs being denied and not even getting a NOA (but I really dont know). Its a weird situation to be in. I do know they do not like for people to avoid paying for the card and get/use free stamps- hence why they have the policy to not give stamps unless you have a NOA for the i90....
