I applied Dec 2018. Got receipt and did biometrics .... and got Prima Facie .

 

I guess (THINK)  its a good thing I did not get RFE .... the new law scares me because I feel like my evidence for abuse is not enough or strong enough... which will result in automatic denial if Immigration officer decides not to request REF for abuse.

Did you do a psychology Evaluation? If yes , then you good, if no then u need quickly get 1 to further prove ur abuse and quickly send it to the immigration,  also friends that witness the abuse can write a notarized letter for you to further prove the abuse then add all with psychology Evaluation and send it in quickly

Or can i dispute it and request for them to review it again? 

If Vawa gets denied you can reapply with a letter to explain in detail ... if you reapply the case would be reopen and nah it dosent start from scratch....

Because you got RFE... 

Mari_ the point of that memo is to stop people from filing petitions as 'place holders'- meaning because processing times are so long some people send in incomplete petitions to secure a spot in line and then gather what they need and use the RFE process to submit what was originally required. If you submit a complete packet you should not be worried about this.

Prima Facie basically means your petition is determined to be approvable if everything checks out. If they were going to reject your packet based on that memo you most likely would not have gotten Prima Facie.  They still can RFE you if needed.

I just received a Prima Facie determination for my application in Jan 2019, unfortunately my interview is still scheduled. I'm very nervous, my attorney tried to request an info pass to put it on hold, but that didn't happen. My interview is in March, attorney is going to prepare me for my interview. I thought we would just go and request to place it on hold? I know many of you have placed your previous I485 on hold from previous marriage, what did you say? Did you get to the interview point? Did you just go in and ask an office before getting called? I'm scared they might deny it. This is in NC. Please help.

What helped me was having a mindset that I believe I have a strong case and the interviewing officer will feel it. I requested to put mine on hold with nothing (360) filed yet. With butterflies in my stomach, my heart pounding you could hear without stethoscope, I faced my fear telling the IO to please put it on hold because I still had to gather my docs to file 360.

 

I waited for my turn to be called and told her why my ex spouse was a no show. I gave her my request letter. She gave me RFE to file 360 in 84days. 

 

Congratulations to your Prima Facie.  That means you have something to show to IO already. Relax your mind and you'll be fine. Put all your energy to what you want to happen. Not what you don't want. I am still mastering this, because I know we have gone through a lot and a tiny distraction could trigger anything scary.

Truth to tell I wasn't nervous until my name was called. The IO was so nice. Sworn me in. I had fingerprints done. It took us 20mins for interview with yes/no questions. She asked for passport and EAD and fotocopies. And confirmed the info on Form 485. She gave me a heads up that no questions would be asked about my past whatsoever. Not even docs about marriage. An hour after I left, I received an online update that my case is under initial review. I am looking forward for approval notice soonest. 

Anyone here with the same experience please?

@username_taken sorry am responding late... yes I applied September 26th.... and I got RFE OCTOBER 28 there abt.. ... USCIS confirmed they received the RFE response and 3weeks after they sent me prima facie January 28th there abt... 

I guess this new law thing it's just there , but it still depends on the officer handling a case, he could choose to do what he likes, just as some offers makes case fast and some makes case slow.... I pray favour and grace for you in jesus name... Amen.
