Probably a dumb question but I am in doubt, we are married since 03/2015. We got 2-year Green card on 2/22/2017. Our 2-year card expired on 2/22/2019. We just received our permanent green card. We are married for over 4 years. When can we file for citizenship? Do we have to wait like an year before we can file citizenship? Please suggest.

04/28/2016 - Packet reached USCIS (i-130, i-485, i-131, i-765)

05/05/2016 - Checks cashed

05/06/2016 - USCIS Email/Text acceptance confirmation

05/09/2016 - NOA1 hard copy

05/13/2016 - Biometrics letter arrived in mail

05/27/2016 - Biometrics scheduled

07/20/2016 - Submitted Service Request for (I-765); Sent letter to congressman
07/21/2016 - EAD card is being produced
07/21/2016 - AP document is being produced

When you got married has little to do with when to get eligible to apply for citizenship. It's rather about how long you've had your green card. There are two things you need to know. In your case, you will be able to apply for citizenship 90 days before the third anniversary of your green card, that is 90 days before 2/22/2020. If you're not married anymore, then it's 90 days before the fifth anniversary. Hope that helps!

@vbms You can use their official tool to calculate when you can apply.

https://www.uscis.gov/forms/uscis-early-filing-calculator

You are eligible for citizenship on or after 11/24/2019 if you are filing under the 3 year rule, or 11/24/2021 if filing under the 5 year rule.

So I am looking to travel soon however my extension letter is a bit damaged I guess because to wear and tear some of the words got rubbed out where the page is folded so I was skeptical to travel on it this time around.  I reached out to USCIS to see if I could get back a copy and they customer service rep told me that they would put in a request for a new copy. After which I asked to speak to a tier 2 officer to see if  it was ok for me to travel with the old letter just in case I didn’t get a new copy. The officer explained to me that they can’t resend another copy of the same letter so it’s best to just travel on the old letter even though the words are rubbed out unless a CB officer makes a note that I need a new letter there is nothing they can do. Just got an email saying they mailed me a receipt notice today which I find weird since I was told they can’t produce it again. So will just wait and see what really comes in the mail. 😔

A bit contradictory.

Ok well they are sending something in the mail with 10-14 days they said so let’s see if they will send me a duplicate copy even though the immigration officer said I couldn’t get a duplicate because they only send these one time.

She can tell the USCIS what she wants but she will need proof otherwise she will just sounds like a bitter ex.

Sounds like you will be getting a divorce and therefore you should switch to a divorce waiver you can ROC by yourself.

USCIS will evaluate the situation, you will have to be ready with facts and evidences rather than anything else

Hire an experienced attorney too even at this stage, in case you don’t have any

If USCIS had the assurance that your marriage was legit and bonna fide, given that you didn’t abandon ur spouse, never used violence, and did not have other sexual affairs, then there will be no red lights from approving your case

It will not be a simple task, but you should be ready with all that, just in case

Goodluck
