I arrived on a k1 and got married last week. I am now going to get my SS#, however on the application form it says:

citizenship: 1)  u.s citizen 2) legal alien allowed to work 3) legal alien not allowed to work 4) other.

i have not send off for the work permit yet along with my AOS so am I right in thinking I select ‘legal alien not allowed to work’

thanks

Hi.

You are a legal alien allowed to work  - regardless if you sent your applications off or not. So, put 2)

Good luck!!

If you want to card in the married name, have a marriage certificate on hand too as evidence of name change.

That said, some SSA offices/workers won't let you use the married last name until you have an EAD or green card in that name. It took my wife 3 visits to get them to issue it in her married name prior to those documents.

If this is the case my wife got screwed by the ss office person.  Her SS card says she can't work.  We applied for SS after we got married.  We are waiting for ead so she can work.  She can work immediately and could have right away as a nail tech

She is authorized to work with proper documentation (i.e. an EAD). That doesn't mean she was allowed to work with only the SS card.

Once she gets her green card, the restriction can be removed from her ss card.  Until then - she is a legal alien, allowed to work, but as it's been mentioned above - with DHS authorization.

Im glad to see this because they just told my wife that she probably needs to wait until her green card arrives (still a long time away yet as we just married last week) and my friend who married a Thai wife had her name changed  no problem after a K1. We think some of the workers have no idea what to do when dealing with foreigners. So we will try another office later. She arrived a few weeks ago, got her ssn a week after, then a week and a half later we got married, so its figured that it's just too soon after she just got her card and that's what is bumping her in the system.

This is a subject that is brought up a lot here and the general consensus is that they don't know what is going on so the default answer is NO. So we always say here to either try a different person or a different office.

This is the one topic that confuses me: SSN numbers and name change. Luckily my fiancée already has a SSN number but we hope the local office will allow a name change with the marriage certificate once she arrives on her K1 next week
