MEDICAL INSURANCE WHILE WAITING FOR AOS

Can someone please help. What do you all do for medical insurance when you come over on a k1, get married, and then waiting on the AOS?? I had my husband on my plan and they just cut him off cause I had told them in the beginning of the year we would have a social security card real soon and they said call us when he does. Well it's been 8 months and still nothing so they cut him off. Ive sent all kinds of proof in that were waiting on all this but it's not acceptable. Also I see some on here say you can come right over and get a ss card, I'm really confused.PLEASE HELP

That sucks. K-1 entrant in AOS limbo is indeed not on the list of eligible immigrants. Looks like you either have to pay cash for the time being, if you need medical care or maybe look into catastrophic coverage, he might be eligible for that. It won't cover everyday stuff, like routine doctor's visits but if he has a major accident or something, it would kick in.

It's possible that once he has his EAD & can get his SSN, you'll be able to put him back on. The website lists EADs as acceptable proof.

You could have gotten an SSN card after entry, but that boat sailed (even if you did get one, I'm not convinced he could have gotten insurance through the Marketplace because he's not a LPR yet).

If he is comfortable with paying cash to see a doctor for now if needed, he could do that. He is still considered a Non Resident Alien which exempts him from having to have health insurance here in the US.

 

The fact that it has been 8 months and no SSN is crazy!

Once he receives his EAD (assuming you applied for it) he can use that to apply for an SSN. If he never he can apply for an ITIN (individual tax identification number) which is used in replace of a SSN but cannot be used for job purposes.. ITIN can be used to open bank accounts, file taxes and so on if they aren't eligable for a SSN. I never got a SSN after entry so I ended up getting an ITIN so i could file taxes. We ran into the same issue with health insurance and after explaining I wasnt eligable for an SSN but did have a ITIN so I can file taxes they were accommodating and noted that in the SSN field until I became eligable to get a SSN

That is great info Moslund, I will look into that. We're also having a problem with taxes to cause i filed an extension tell Oct thinking we would have his ss by now and we just got a letter from USCIS saying they needed my 1040 form or I would have to find a co-sponser I quess my w2 forms didnt work for them. Waited 6 months to get that response. UGHHH... this is so frusterating

It took I think around 2 weeks to get my ITIN from when I applied for it. So atleast if you decided that you wanted to go the ITIN route then once your recieve it you can turn around and do your taxes which might be enough to fulfill the RFE then there would be no need for a co sponsor. Your insurance company may be happy having a ITIN on file until your eligable for the SSN to reinstate his health insurance coverage. Only pain about an ITIN is once you do get you do get the SSN you need to inform IRS that you will no longer be using the ITIN since the SSN trumps the ITIN

This is why you file for a SSN as soon as you cross the border. You’re kind of stuck now because everyone requires SSN for insurance. Maybe try traveling health insurance through his country. But I don’t know if he needed to have gotten it before he left. That’s what we did. Got traveling health insurance for a month just to be covered until we were able to add to existing plan after marriage.

Hi everyone, recently applied for aos and I already have ssn with my maiden name. My husband just add me on his med insurance using the married name, will it be a problem since i havent change my name in Ssoffice yet - still waiting for ead to do so

Applied for AOS/EAD/AP : August 7, 2018 (via USPS)

USCIS Chicago received the package: August 9, 2018

Someone can correct me if they have other information or if this varies by state but:

 

I was told that a marriage certificate constitutes a legal name change even if the SS office hasn't had it updated yet. So if you list your new last name and (for example) the insurance company or bank or who ever comes back and asks questions, you can present the certified married certificate as proof that you legally have a different last name, even if it hasn't been updated at the SS office yet.
