K1 visa.. fiancee in malaysia but born in phils

It depends but do you know if your fiancé is in Cyprus legally and with a resident visa?

How was she supporting herself before you came onto the scene? 

 

A recruiter finds people for an employer. Who is she living with? Is she working for payment in kind (e.g. Housekeeping or babysitting in return for room and food)? I have never heard of a recruiter being needed or used to get a tourist visa. Or a young single woman going overseas for 4 years to Malaysia to just take a huge vacation. Usually Filipinas go overseas to work. Not to spend 4 years sitting on a beach. Are her parents wealthy?

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

If she stayed in Malaysia over 6 months she needs to get a police clearance from Malaysia. Just wondering, she only have visitor Visa? As far as I know visitor Visa is just for 1 month then if  u extend it up to 2x and a maximum of 1 month every extension. Unless she used to in and out Malaysia. I just hope she never stay in Malaysia illegally. I would advise her to process in the Philippines coz she will b needing more original certificate such as cenomar birth cert etc in her home country.

So how is she going to take the required CFO seminar (only given in the Philippines)?  She will also get a stamp in her Philippine passport and that will also be done in the Philippines.  She will also need many documents from the Philippines that you have to stand in line for sometimes day after day until you get them.  My spouse stood in lines (me with her) for literally 7 hours and then were told to come back in a few weeks on several occasions.  You have to be a pit bull to get these documents.  They make it extremely difficult. Try getting these documents mailed to you in Malaysia...good luck.

if the recruiter refuses to return her passport she is being held, or is working/trading work for room/board, staying is not a good option, it looks to my uneducated eye as an unsafe situation, the most prudent action should be to return to a place she has control of her actions. I am not saying she is being held or engaged in nefarious activities, you are supporting her regardless, this falls under better safe than sorry

The CFO sticker is only needed when flying out of the Philippines with a K-1 (or immigrant) visa.

I stand corrected.  I did not know that.  But she'll have to return home to gather up all her needed documents anyway.  That CFO class was such a hassle and kind of a joke until I read this post.  This sounds like this could be a case of human trafficking they warn Filipinas about at the seminar. david

Agreed...something is a bit odd with the passport situation. Either way, I think the best thing is to process the case in the Philippines anyway.

I guess ur gf works illegally in Malaysia. Holding a tourist visa are not allowed to work. She better go back to Philippines before she get caught for working without a valid working visa. There are lots of cases in Singapore and Malaysia, Filipinos holding a tourist visa yet they worked secretly and their recruiter/agent are the one who keep their passport.

Every country is different. In Philippines, intending immigrants need to attend a CFO seminar before we can go out from the country. Without the stamp from the CFO, immigration officers won't let us board on the plane. And that seminar is only done in the Philippines, as far as I know of.

Agree 100%.......If I were the OP, I would try to get the fiance back to PI.  Something is amiss here, imo.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Correct. But I will note again this only applies for people flying out of the Philippines. For Filipinos that fly out of another country, no CFO seminar or sticker is needed.

Plenty of human trafficking is done with visas... Human trafficking isn't just sneaking people into a country w/out a passport and/or visa.

Something is a miss? Yeah right because there are a couple big things that are a miss right now that I can think of.

Exactly and the whole SE Asia region is rampant in Human Trafficking to either other countries within the region or to the MENA Region.
