K1 visa.. fiancee in malaysia but born in phils

True, policies do vary by embassy or consulate. But they were outright wrong to say she could interview at any location regardless of status...the vast majority require legal residency for a K-1 or immigrant visa (which is not the case for a regular non-immigrant visa...maybe that's where they were confused?).

I think it's just one of those things that vary by embassy like you stated and they allow it and the people there think that's how its handled everywhere. I was very clear with them about her status not being legal and that she could go back if need be and they told me it's fine that she can do it there. Regardless OP should contact the embassy there and see what they tell him.

Not true.  Not Montreal as one example

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Understood, it may vary. I am just informing what the person said to me twice. OP should definitely call first and speak to someone in regards to that embassies policies.

Exactly. Call first to confirm, but interviewing without legal residency would be an exception to the rule, not the rule.

So, should i go and petition her? She is willing to go home and so theninterview in phils if she has to.. im applying it here in US

That's a decision you have to make and feel comfortable making. I'd contact the embassy first and be honest and explain your situation in a detailed manner. I'd even try again a couple of days later to speak to someone else. If you decide to do it in the Phillipines make sure she tries to get a Police Certificate from there if they allow it.

 

In my situation I'm okay if they try to change their minds and reroute it to the Philippines. She will just fly a couple of weeks later and do the interview there once the paperwork arrives.

Which embassy i have to call? Thank you so much for your help.. a friend told me that as long as there is a philippine embassy and US Embassy in malaysia.. she will be okay..

US embassy. She definitely should visit the Philippine embassy in regards to her passport issue though.

She will not interview for a K-1 visa at the PI embassy......Interviews are done only at US embassies/consulates.

Yes she is.. but she is waitif on her visa ( in malaysia/ renew) before she can go home..

Something is fishy here.  Her "recruiter" is holding her visa/passport?  Sounds like human trafficking to me.  You better make sure you got the story straight.

She will also have to complete her CFO Seminar in Philippines and have her passport stamped before she can get a visa.
