Nope, you are definitely not allowed under the 3 year rule.  You must be married to the same US Citizen spouse for all 3 years.  Sorry.

I did not, in fact this was the first notice of any kind I received since the NOA

No. You either get your biometrics waived or you need to do them again 🙄 they won't change their mind now.

Got our biometrics appointment in the mail last Saturday the 1st and is scheduled for Monday June 10th but we will be on vacation starting this Saturday the 8th! Bummer! Sent letter in today requesting a new appointment. If we had not paid for flight and hotel already there would be no problems. What are the odds of that happening after 10 months of nothing? Hope they are understanding!

Just saw the notice on the old USCIS site that our case was also transferred. Just going to wait now, to see to where. It seems that lots of folks are being transferred, and I'm happy there's at least movement.

I haven’t seen anything saying there’s a 90 day window for citizenship only for Removal of conditions. I believe there is no expiration date for n400 because you don’t have to choose to be a citizen or you can choose later on to do it. It’s not required it’s more of a choice. You just have to fulfill the requirements of having 3 years of being a green card holder, so that would be October 26th for me and I’m married to the same spouse if I was divorced you have to wait 5 years to file N-400.  You also need good moral character and to be living within the US in the last 6 months

Yes you are right.

it is your choice if you want to apply for citizen ship or not.

Yes I am ... sometime in mid-Aug. My GC was issued in mid-Nov 2016. We have been married since Aug 2015. So I fulfill both conditions - married for 3 years at least and 90 days prior to 3 years of GC.

Arrived in US on F1 Visa in Dec 2008

Graduated and started working on H1B visa in Jan 2012

On H1B visa until July 2015.

Applied for GC : Sept 2015

2 Years GC through marriage : Nov 2016

I have exactly the same time line as you!!! 

 

But the difference I got divorced and I am so nervous about the 10yesr green card...
