You will also need a waiver for the ban. Hope the lawyer knows that. 

 

My opinion? She overstayed her visa then voluntarily left US. Good luck with your journey but I sense small chances for expedite. 

No. She entered USA with student visa legally. She has no any bans.

K3 doesn't exist pretty much. 

I suggest changing lawyers if he doesn't even know that. 

We tried all our best during these 2 years to meet each others. It's a long story. U don't know what happened in these 2 years of trying to visit each other in Dubai, or SA. Her family were trying to push me to go to SA to remarry an Islamic way so maybe it fixes things. We were also authenticated our marriage certificates through DOS. Her family who make sense came to visit me with tourist visas, but she could not cuz her oldest brother didn't want to give her passport. Her family members who make no sense, said she should not see me again until I convert. Then after I converted, her government said no cuz the marriage happened after the government permission. During these 2 years so many things happened before she decided to return after she got death threatening from her guardian

Firstly, fire the lawyer. Any lawyer recommending you pursue a K-3 is not worth the money he is charging.

 

If you are unemployed a K-3 is the worst choice anyway as your wife won't be able to work for some time. The IR-1 will mean she can work right away and it's cheaper.

 

If her brother won't give her her passport, how will she come here anyway? Maybe you need to look into moving to Dubai and see if she can get there.

I think u misunderstood when I said illegal, I meant our marriage can not be recognized in her country SA because it's considered illegal, against her law. I didn't mean she was illegal in USA she was on F1 student visa. She had her scholarship to study her masters in USA. You need to read well before replying by saying this (10 years ban)  in each reply u post. I'm here asking for humanitarian help but u say my wife will get 10 years ban?!!!! Just cuz she left USA before her student visa expired. She never overstayed her visa. Her student visa expired 1 month ago. She left USA in 2017 to visit her mom and return, but consequences happened!!!!

When you first say she was in the US for 6 years you could have mention she was on valid visa and never overstay. Fishing for informations is never fun. 

 

But anyway - all your questions should be answered by lawyers because no one here can help really.

When I went to Dubai to meet her, her brother had her passport. Then I had to go back to usa to authenticate our marriages so I become able to make her POA based on the SA authentication. She asked for a new passport, they found out her daughter is illegal in SA, they told her bring our authenticated marriage certificate and my POA and then they will issue her a new a passport and a deportation paper for our daughter so they can both leave SA, otherwise saudi Immigration and religious police do their jobs if they found out she's still keeping an illegal daughter in SA from a non Islamic marriage.

I was trying to summarize the long story mentioned so many times in so many websites and to so many lawyers. It's hard to summarize a story that started since 2016 till now. So many info need to be told. I said she is from saudi arabia not Mexico, so it makes sense she was on valid visa.

But she already has SSN valid for work only. She got it after she got graduated because she was planning to work, since she studied in medical field, she had to get SSN which is valid for work only for non citizens.

Let me try and summaries the salient points:

 

Parents and child are Muslim

 

Father and child are USC's, the wife is not.

 

Parents married in US, Mother returned to Saudi to give birth and Mother and Child are still there.

 

Not sure when a 1 130 was filed, process takes a year or so, child could move now.

 

Might be an issue with sponsorship, Father is unemployed, sounds like a Joint Sponsor is needed.

 

Father is concerned about local laws and their impact on his Wife, wants to expedite due to that.

 

Well anybody can request an expedite, not sure there is a case for one, but no downside trying.

I born Christian and when me and my wife got married, no one pushed the others to convert. But then I had to convert, it happened after the marriage not before because her government crimininalized her by committing apostasy, marrying against Islamic laws is a crime in SA. If my wife and daughter are still Muslims in SA eyes, so it wouldn't be a problem. My wife and daughter are not Muslims anymore in SA Islamic law. That's the problem. So in USA eyes we are Muslims, but we are infidel in SA laws. That's not fair at all. No wonder why atheists became atheists. So to be honest, me and my wife need to rethink about having a religion in our life because of what it made up ending right now.

I can't let my wife send my one year old daughter alone into the plane. I can't take her daughter away from her. I either bring them both or leave both. What I need is to save both their lives. Not crazy to take my daughter and leave my wife struggling there alone. That's the worst thing someone can do to a family

Ultimately, your wife made these decisions. She surely was aware of the laws/consequences regarding marrying non-Muslims, given that she is a citizen of KSA. She willingly got on a plane to return, pregnant. No one put a gun to her head here and told her to leave. Her mother suggested it but she didn't have to go. 

 

It's unfortunate that it's resulted in this but she must take some responsibility for her choices.
