I agree with @David & Zoila. The only posts I have read over the past few months  (since the bans were in stated) were "my fiance/wife was denied due to the ban"). I am afraid it will be several months before you will be reunited with your loved one. Someone with more experience/knowledge of the waiver process can respond....but as of right now....I don't know if a waiver exists (since this is a new phenomenon).

However, once the visa is denied (if the visa is denied) there is an appeal process....there may be some options at that point.

@salhasl

I spoke with one of the Reuters journalists that wrote the story and they said the data received had no further breakdown beyond what was published.  So as far as I'm aware there isn't any good data available to determine what you want. With SCOTUS hearing oral arguments against the ban on 25 April, it's best to try to delay your interview until after that. The decision is expected before the end of June. That's what we're doing as best as we can.

NOA1: 26 July 2017

NOA2: 2 February 2018

NVC Received: 13 February 2018

NVC Case # Assigned: 22 February 2018

NVC Left: 27 February 2018

Consulate Received: 1 March 2018

Packet 3 Received: 10 March 2018

Packet 3 Sent: 8 October 2018 (we delayed intentionally)

Interview: 31 October 2018

Currently in AP!!! :(

So separation from a spouse does not meet  the hardship clause apparently in legalese.

So there we are. Collateral damage I guess.

No other option than to wait for the sluggish, sedated wheels of justice to turn.

If separation from a spouse was considered a hardship, all our cases would qualify for waviers and expedited processing.......separation from a spouse is a normal part of the immigration process.

Hate to beat a dead horse. There is a difference between normal wait times and an indefinite suspension with no guidance for the future. But you already knew that.

Correct. Separation alone is not considered an extreme hardship. It's always been this way, or else there would be no point in even having an I-601 (hardship waiver) for inadmissibilities for a spouse.
