It is best if new members fill out their timeline and create new posts rather than bumping an old thread from 3 years ago.

 

To answer your question, your husband would have been the one who filled out your initial I-130 application so he will be your first sponsor and must fill out form I-864. Unless his income comes with him from Peru you will need a joint sponsor who will also fill out form I-864.

 

The guides above on the forum are very helpful and you should familiarize yourself with the process.

Hi everybody!

my husband is an american citizen and he is my petitioner, but he  does not meet the minimum income to be a sponsor so his sister, who is an American citizen will be our sponsor because I am Peruvian and I need it, however there is a field in the form where they ask "indicate the #Total number of people who are immigrating "then I must place 2 (him and me)?

He has been living here in Peru with me. Would he have to be included on the information form when asking for a sponsor?

I may be totally wrong, as my situation is not similar to yours, but I would assume an American citizen (your husband) would not be migrating to the US as an immigrant, because he is in fact a citizen already.

Does he live in Peru permanently but he has double nationality or did he travel to Peru to be with you for the time being until you can go back to the US with him? If your answer is that he has been with you for the time being until you can travel to the US, the number of people immigrating with you is 0 (as no kids or family is coming with you, someone who's not a US citizen). Now..does it say that you have to count yourself? because then it would be one (as just yourself is immigrating to the US to marry/be with your husband ^_^

If I am correct here,  since your husband is a US Citizen, it is not he who is immigrating, only you.  He is your sponsor / petitioner (regardless of where is is living at the moment), and his sister is a co-sponsor.  I do believe it should be your husband and you doing the paperwork, and add his sisters' information as needed,  files, income statements, tax stuff to establish eligibility.

Since he is a U.S. citizen then he is not immigrating with you. Your husband needs to fill out form I-864, and his sister will fill out a separate I-864 as well.

If, exactly, he only has the American nationality and only came to Peru to marry me, now we want to return to the states together. Thanks for the information, I will place only 1 immigrant in total (me), however in what part should I put his name on the forms? since they told me that he needs a sponsor as well since he has been living in Peru for a year so he does not have to show the W2 with his income because he does not exceed the minimum requested. I think this answered lines up :)

On the I-864, Part 1 should read "I, (your husbands name) am the sponsor submitting this affidavit of support because"...and then he check the first box that reads "I am the petitioner".

On his sisters I-864, she puts her name & checks the box for "I am the only joint sponsor"...they each fill out their own forms as sponsors (even though he doesn't make enough he still has to be the main sponsor since he's the petitioner).

Your husband IS the primary sponsor (petitioner) whether he qualifies or not.  If he doesn't, then the joint sponsor also provides the same form.  If the joint sponsor is married, their spouse provides the I-864a.

I have a few questions in regards to the sponsor form I-864, I married a Peruvian about a year ago and we are in the current state of submitting for a sponsor. I understand that I am the primary sponsor but, since I haven't been or worked in the USA I would need to have a joint sponsor, is this correct?

 

I have also read that they requiere your most current tax information, the most recent I have would be from 2016, with that being said should I find a way to provide the 2017 tax information or just write a letter saying why I can't provide such information. My taxes from 2017 won't meet the requirement seeing that I only worked for two months before moving to Peru.

 

The documents I am reading also state that this information isn't requiered until the immagrant (my wife) is scheduled an interview, we have reached out to them but, have not been given an answer in regards to our concerns.

 

Any further information will be greatly appreciated

I was reading this:

"You also must meet certain income requirements (whether you are a sponsor, a joint sponsor, or a substitute sponsor). You must show that your household income is equal to or higher than 125% of the U.S. poverty level for your household size. (Your household size includes you, your dependents, any relatives living with you, and the immigrants you are sponsoring.)"

 

So I need to know if my sponsor who is an American citizen has a child less than 1 year old, and his wife, then to know the poverty guide, does your youngest son count? in total would be 4 people? (the wife, the son, my sponsor, the immigrant)?

Please help me!

The sponsor's household is:

  • Himself (1)
  • His spouse (1)
  • His children under 21 years old (1)
  • All intending immigrants being sponsored (1)
  • All immigrants he is still responsible for due to past I-864s (?)
  • Any other dependents claimed on his most recent tax return (?)

 

As a heads up, they may request a signed I-864A from his spouse as well. It's not strictly required, but they have done this before (probably to ensure the wife is aware and onboard of his commitment).

My husband is American and he is the main petitioner but since his income is not enough, we will have a co-sponsor, my husband does not count to be sponsored right?
