IR-1 visa outdated police certificate

Hello I'm hoping someone can give me a little insight or hope, so my husband is a canadian citizen and his interview on Feb 26th  in Montreal ( only about a week away) and we just realized that his police certificate is outdated and there is no possible way to get one in time for his interview..all I can get is a receipt for the new one we sent away for. I still have the outdated one and the NVC accepted that one when we filed all his paperwork. I sent an email to the embassy but now I'm freaking out not knowing what will happen since I can't get a refund on our airplane tickets any help appreciated!!

It was my understanding that medical is good for 6 months and police certificate is good for a year.

Correct but our police certificate is from 2016 and expired June 2017

I don't remember reading anywhere that the police certificate had to stay in date during the whole process. Some cases take much longer than a year and I can't imagine that they keep asking for updated ones.

 

Having said that I didn't apply for mine until my case was received at the NVC as it's not needed sooner than that, you must have requested yours early.

Dec-15-2017 - NOA2 I-130 approved

Jan-08-2018 -  NVC received

Jan-17-2018 - Received DS-261 AOS bill

Jan-17-2018 - Paid DS-261 AOS bill & submit 

Jan-26-2018 - Received IV bill

Jan-27-2018 - Paid IV bill

Feb-10-2018 - Send IV package

Feb-13-2018 - Scan Date

Feb-27-2018 - NVC Case Complete

Mar-17-2018   Receive interview date for April, St Patrick's Day good day to be Irish

Apr-17-2018    Interview at Dublin Embassy 

Apr-17-2018    Interview completed now in AP pending submitting other paperwork

Apr-25-2018    Additional information provided as requested 

May-09-2018   Visa approved, CEAC status changed to "Issued"

May-11-2018   Passport returned along with envelope for border control. 

Sep-18-2018    Entry through US Precleance Dublin, no problems at all.

 

Aug-27-2021   N400 for citizenship based on 3 year rule filed electronically

Aug-27-2021   NOA1 application received

Oct-02-2021    Notification of biometrics date

Oct-26-2021    Biometrics 

Jul-27-2022     Interview Raleigh NC, passed and same day oath

We ended up having to resubmit to the nvc because our case had expired and I didn't even look at the date on his certificate it expired in June of 2017 and it takes 3 to 6 months to receive a new one :( but NVC accepted that document just this last November so idk what will happen

If I may ask, does your partner live in canada or imthe US? I know sometimes you can luck out by going to a different police station if you live in a city. I got my police check just by walking up to the desk at the station in my hometown.

He lives in Canada but because he was convicted of a crime he needs to have a fingerprint search done which has to get sent away no matter where we go unfortunately

Like the other posters said, they probably just ask you for it and put you in a waiting period until they get it.

i was worried as our case was at NVC for so long

no problem / it was not an issue

worse case scenario is they will do interview and put u in AP and request new one

They will ask you for new police clearance , certificate ,  they won't issue you visa until you submit new one , 

Sorry you have to go through this , 

Maybe if you get nice interviewer and he won't ask for it ,. But that's a big maybe

As others have stated, most likely - your fiance can still attend the interview and get an approval on the condition the Canadian consulate receives an updated police certificate.  It would be like getting a RFE, then getting everything cleared once the evidence is received.

If it were my fiance, I'd ask them to go to their local RCMP station and see if they can request an updated police certificate for immigration purposes - regardless if my fiance had a prior criminal record or not.  

My Canadian wife (fiance at the time) was able to get her police certificate for immigration purposes at her local RCMP the same day - granted she did not have a prior criminal record.   

The police certificate for immigration has the header as the image I attached below.  The reason I attached this image, is because some RCMP staff have no idea what a police certificate for immigration was.  Once a  supervisor saw this header, he knew exactly what were requesting and how to get it quickly.   

Its worth a shot.

This, in deed is the worst thing that you can face and deal with! It´s only gpoing to slow down the process, I know, it´s hard, more wait, but anything else can be done! So sorry to ear about this in your case!

Buying airplane tickets that are not refundable, BEFORE the visa is in hand, is ill-advised.  However, if the police certificate was issued less than six month ago, it will be accepted, whether it has an "expiration date" on its face or not.  Consular Officers go by their own standards for the age of Police Certificates, not by expiration dates imposed by foreign governments.

 

All that said, simply go get an updated certificate from the RCMP.  You have plenty of time.
