Question about visiting?

I extended my current stay in the USA while visiting my fiancé, I’m staying until January 7th so it’s an extra 3 weeks. Do I need to let anybody know I’m staying longer, visiting visa wise or is it okay as long as I’m still under the 90 days on my visiting visa? Should everything be okay? Just double checking. 

K-1 Visa

06/21/17 - NOA1
12/22/17 - NOA2 Approved

01/24/18 - NVC Received I-129F 
02/02/18 - Case Number Received 'In transit to Embassy'

02/08/18 - Embassy Received. Case status set as Ready
03/02/18 - Medical 

03/09/18 - Interview 
03/15/18- Visa Issued
03/20/18 - Visa in Hand
03/24/18 - MI Bound

Timeline

The visitors visa (B1/B2) has nothing to do with 90 days. Your passport was likely stamped with the date that you are approved to stay until. 

 

Sometimes they will mark down the max amount of time you can stay (for example, 180 days), but other times they will mark down the date of your return ticket. It really depends on the customs officer. You MUST check this. If they didn't stamp your passport you can find this information by looking up your I-94 record online.

 

If you find that you need to extend it, you would need to file a I-539 extension form along with a hefty fee. It's actually much cheaper to leave the country and return a day later which is what most people do. Visit Mexico or Canada if the drive is possible, and when you return they will give you a new entry stamp with whatever exit date you tell them. Worst case scenario is that you may need to return home and come back again the following day.

Sorry, I just wanted to clarify with what I said above, the processing time + fee of the I-539 is so crazy for a tourist visa, that I don't know that ANYONE would be willing to do it. It really is cheaper to leave the country and return again and definitely going to be much faster.

 

The consequences of an overstay on a tourist visa can come back to bite you, so I recommend you follow caution - and hopefully they just stamped your passport many months out.

They stamped my passport for the 26th January and I have a return ticket for the 7th January, should I be okay?

Yes, you’ll be fine. Doesn’t matter if your plans change as long as you don’t overstay.

I assume you are using the VWP and have been stamped in for 90 days, just need t o leave within 90 days.

OP is using the VWP. This cannot be extended behind the 90 days. I-539 does not apply here. Also visiting Canada or Mexico does NOT re-set the clock for VWP people and she would not get another 90 days by hopping across the border. Not that any of this matters to the OP as she is still leaving before the 90 days are up but for the benefit of lurkers and readers with a similar question it's important to point out that what you have said does not apply to those using the VWP.

You don't need to inform anyone apart from maybe your boss back home who could be expecting you back at work. Presumably you changed your flight reservation with the airline?

I assume you are traveling under an ESTA. As long as you stay under 90 days, you will be fine. Enjoy your visit and good luck on your K-1 Visa!
