Moving to the states to live with my gf

Hi, so i live in canada and my gf lives in the states. Alabama to be exact. I dont know whats the process for her to get me there, but what's the best way for me or how can i move there to live with her without a job offer? i was told i need a green card to work and to get married. Or does she just have to fill our some forms first to sponsor me?  Also i am married in canada but we are split and living seperate, do i have to legally divorce her before marrying my gf?

K1 Visa ( Fiancé Visa ) or get married then apply CR1 Visa.

but as you are still married, you have to divorce your wife legally to be able to do either or visa way.

or get a job then trying to apply for employment visa, but you mentioned already that it wasn't an option. The best /fastest thing would be divorce---> apply K1-----> get married

To my knowledge there are no US visas for simple co-habilitation with a girlfriend.  As the others have said, get divorced, then research the K1 or CR1 visas if it is your intent to get married to your new girlfriend.

Only step you should be doing right now is getting that divorce. You cannot legally marry someone in the US if you are still legally married... If your divorce is going to be uncontested, you can do it yourself (save money) then have your gf/fiancé file for K1 Visa to bring you here.

This is the big assumption we are making.  The OP didn’t say anything about getting married to the girlfriend in Alabama, they are just saying they want to move here and live with the GF.

Many, or I should say, most North Americans/ Westerners  are ignorant to immigration processes. They think they can just waltz into a neighboring country and start living there. So it is not surprising to get a question like this. And I would give the OP slack on that.

 

But the whole still being married and wanting to know if he has to divorce before marrying his girlfriend is another story. That he should know better.

 

I still remember the funny story of the Canadian moving to the US on a visitor visa. She was denied entry at the border because she had a U-Haul trailer attached to her car. She honestly had no idea it couldn't be done like that.

bigamy is a crime in Canada and US.  us law specifically deny visa to anyone coming to us base on bigamy.  

 

yeah, she must file immigration petition after u divorce.  takes 1 year for u to get visa.
