Out of curiosity (it is not my plan)- so what happen if someone report someones marriage as sham marriage while CR1/IR1/K1 is processing?  How USCIS or NVC reacts to this? Lets say, there is a proof of sham marriage -they dont live together, are friends more than partners, proofs-text messages. Do they decline the I-130 based on the proofs, or do they still send it to embassy for interview even they have doubts? Do they actually even care for such reports from jealous friends, vindictive ex?

Well Domicile and Residency are different, reasonably easy to say when you clearly qualify, much harder when people are trying to push it to the edge.

 

And different Consulates take different views. No doubt those views change over time and sometimes by CO.

Well I asked what happens/what is the process, once someone report a fraud marriage with provided "proof"- lets say that the proof works. I didnt mean any specific case nor a specific couple. wanted to know if the people still go to interview, or would have to submit RFE...etc

I would expect the proof to be mentioned at the interview, which may end up being rather short.

Unlikely, interview would the time to raise those issues.

That would very much depend on the situation.

 

For example somebody said they were single but that is a Marriage Certificate.

 Them not living together and text messages (that could be fabricated) provided by a 3rd party is very much hearsay.

USCIS sometimes do home visits (for couples that process in country of course) to determine if ppl live together. If the evidence of that was strong enough (and also not a temporary arrangement due to work circumstances or such) I suppose a home visit would be possible.

Other than that I also believe it would be brought up at an interview, as mentioned by others.  The couple themselves provide evidence of bona fide marriage. The evidence proving otherwise would need to be quite strong and not just hearsay and easily fabricated text messages.

I could be mistaken, but this sounds totally like you’re fishing for what to use to report someone to USCIS. For someone who’s “just curious” you’re asking a lot of detail on a fairly specific presumably hypothetical case.
