i-751... anyone approved WITHOUT an interview?

Hi all,

 

So many stats claim circa 10% of people applying for ROC get interviewed after their bio-metric appointment, but the more I read up on here, it feels lately that it's more like 90% of people have had an interview and nearly 100% an RFE.

 

My question is... is there anyone out there that got through this process clean and simple? So sent off forms and evidence, did the bio metric scans and then next thing you know a green card is through the door 6-12 months later? 

 

Like many of you, I'm sitting here stressing about something that hasn't even happened, but i'm 100% certain i'm not going for an interview based on what I'm reading on visa journey.

 

Just curious for thoughts on this one as it feel like RFE and Interviews have taken a sharp increase...

What's so bad about having an interview?

No interview here, for AOS or ROC. No REFE's either. It has been a while, but that's my experience. And it took 11 months to ROC.

I can explain it to you. But I can't understand it for you.

i did not have an interview. although, this was a couple of years ago.

2006 - Entered US on F-1
2009 - COS to H-1
2011 - Married USC

Conditional GC Process:
04/2012 - Concurrent I-130 petition / I-485 AOS / I-765 EAD / I-131 AP sent
35 days to biometrics, 73 days to EAD/AP combo card, 85 days to interview, 96 days to Conditional Green Card

04/2014 - Eligible for ROC

06/2014 - I-751 package filing joint with spouse sent

5 days to extension,37 days to biometrics, 172 days to CSC transfer, 247 days to Green Card

04/2015 - Eligible for Citizenship

09/2015 - N-400 package filing on basis of USC spouse sent

29 days to biometrics, 105 days to interview, 147 days to oath and US citizenship

~ 9 years and 6 months from first entry to US citizenship

I've been actively monitoring a couple months' ROC threads around the time of my wife's application, and I wouldn't say I've been seeing very many RFEs or interviews at all. They seem to be very much the exception, rather than the rule.

 

(But I would throw out the idea of getting the 10-year card within 6-12 months; it's very hard to say, of course, but given the recent slowdown, particularly for applications routed through California, expectations of 12-18 months, or even longer, are becoming more of the norm.)

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

I didn't have an interview for my ROC...no RFE's either.  I had an interview for my AOS, though, since it was based on marriage.

 

At this point, I'm just hoping my N400 goes just as smoothly and quickly as my AOS and ROC did.

Several years ago it would have been that fast...not any more.

Hi I had no RFEs and no interview either.

 

However what happened was, they had an old address on file (although I changed it online) and they sent the GC to the old address! Then I received a letter (to the current address) that my I 751 was approved and I should receive my GC. I saw that the date of the letter was one month after biometrics. I setup forwarding and received my green card about a month after that.

My wife and I had an interview for her AOS but for the ROC nothing. Actually hope you get an interview because it does help speed up the process along rather than no interview at all. Also PLEASE FILL OUT YOUR TIMELINE so that we can help you more efficiently.

I regularly read the RoC monthly filer threads for each month of the second half of 2016 and I can say in my reading experience there are few reported RFEs and very few reported interviews.

And I bet the ones that were interviewed or RFE'd joined the thread once they received the notice down the road. people who prepare their packages with the help of other VJers go through more smoothly than the others.

To the second comment, it's not that there is anything to hide. It's just a very stressful situation that's all. I think we can all agree that the whole process has been stressful! 

 

Hearing many of you had no RFE or interview is encouraging!

 

Also, just want to say what a great community we have here! Such helpful advice!
