Question?? And maybe it's be answered but do I need to submit my actual original marriage certificate with I-485? Is a copy not good enough? And if I do that means I never get it back. Right?

The rule of thumb is send photocopies. If you're called for an interview, bring originals. You won't get anything back if you send it in the I-485 package.

Agree with @Adam&Allison also if you need additional certified copies then you may personally go and get certified copies from your local county court for each copy as less as $3 or so. I ordered 3 copies when i got married and sent in one of them with my AOS application.

I sent a photocopy and didn't receive an RFE for it.

It is necessary. 

 

Include a certified copy of your MC in the AOS packet and then photocopies for the EAD and AP packets if you are filing them concurrently. :)

From the USCIS instructions: 

 

 

Marriage Certificate and Other Proof of Relationship

 

If you are filing Form I-485 as the derivative applicant spouse of the principal applicant, you generally must submit a photocopy of your marriage certificate issued by the appropriate civil authority where the marriage took place. Refugee derivative applicant spouses do not need to submit a photocopy of the marriage certificate. There are also some immigrant categories that require the principal applicant to submit a marriage certificate (for example, K-1 nonimmigrants (person admitted to the United States as a fiancé(e)), abused spouses and children under the Cuban Adjustment Act (CAA), Haitian Refugee Immigration Fairness Act (HRIFA) dependents, and abused spouses and children under HRIFA). See the Additional Instructions for more category-specific information. 

If either party to this marriage was previously married, you must also submit evidence to prove the legal termination of any prior marriages, typically a divorce certificate or death certificate. If a required marriage certificate (or divorce certificate or death certificate) is unavailable or does not exist, you must demonstrate its unavailability/nonexistence and provide other acceptable evidence as explained above for birth certificates. 

 

 

In addition to the evidence listed in the What Evidence Must You Submit with Form I-485 section, you must submit
a copy of the marriage certificate to show that the K-1 nonimmigrant fiancé(e) married the U.S. citizen (Form I-129F petitioner) in the 90-day period. This additional requirement applies to both K-1 principal and K-2 derivative applicants. 

 

 

 

So yeah,  photocopy is fine. I sent a photocopy with mine, also a photocopy of my husbands divorce certificate and they were both accepted no problem. Good luck! :)

Form I-864 is the form I think I need for affidavit of support, says it expired on 7/31/2017 but it's on the uscis website. Is it ok to use? Did everyone else use this form even though it's expired?

when you open the form and on the first page right corner it says "expires 07/31/2017" but if you look on the uscis webpage under "Edition Date" it says """07/02/15. A new edition of this form is coming soon. In the meantime, customers may file using the 07/02/15 edition.  Previous editions are also accepted.  You can find the edition date at the bottom of the page on the Form and Instructions""".

 

We all used the same because the date "07/31"2017" is for USCIS internal purpose and not for applicants. So go ahead with this application. If there was a newer version USCIS would've updated it on their website. All the best :)

I got the NOA1 in the mail today. Like I said, four of them. One each for 130, 485, 131 and 765. I guess I accidentally attached a eNotification thing to the wife's I-130. It was in her name so *shrug*
