The fact you mentioned your ex's surname in the petition shouldn't be that big of a problem. When you fill out any official form, there's always the implicit agreement that you are doing so 'to the best of your knowledge and ability'. I think you could explain the misunderstanding and it shouldn't really be binding.

 

Of course, this is just my logical thinking (that sometimes fails) and maybe wishful thinking...

I'm just thinking now if I should include my ex's surname when I put the application forward to the embassy or if I should not include it and say that we realised that I was not officially known as that name?

 

There is no register or Civil Records in the UK (atleast that I know..)  like it is in Norway for instance where you apply to change your name. The only way you do it here is with something called deed poll.. which I never did because when you are married all you need to do is to show your marriage certificate.. So confusing lol

I think if I was in your position I would fill the DS-160 with the real information, based on current facts. I mean, you now know you never really changed your name legally, and it seems to me that's the only thing they want to know, names used legally for any kind of transaction or legal proceeding, so they can perform the appropriate background checks.

 

And yep, all that changing names thing is always confusing and weird to me, because in Spain we don't change our name when we get married :unsure:

I never knew before that i will feel so happy for people i never met in personal ! but I do !!! 

we are not scheduled , waiting case to Moscow...i guess next week ) !!

I never had to change it through a deed poll and the way I changed my surname back on my bank account was by simply showing them my divorcee decree... I'm not sure how I would ever get a police report showing both names when I was never really officially known by it, however it is mentioned in the application...fml.. 

I am not sure how UK police reports go, but on my Canadian police report it only stated the name I have now (which is my ex- husband's last name because I just never got around to changing it). When I filled out the police report for them to do I included my maiden name, but on my actual report it only shows my current last name.  I had no problems at my interview!!

Received I-797 showing petition approved August 17.  Also, received letter in answer to my inquiry also stating that petition was approved.  Yet there has never been an update on the online case tracker which still shows case received and I've never received text messages or e-mails even though I signed up for those. Wondering if I should bother to call them to ask why or just ignore since I do have the I-797.  I may call the NVC next week if I do not hear from them.  If there are some issues with their online tracking system I'm sure they are aware and I doubt that they care too much about it.

Approximately 2 weeks after receiving NOA2 you can begin calling the NVC for your case number.  It is typical for it to take NVC 4-6 weeks to receive your case file and contact you.  Once you have your case number you can complete the DS160.

Yes I did, but mine was changed to my "married name" on my license, passport, etc.  Since I never went legally back after we divorced, I did include my maiden name on my I-129.  I think your situation is a little different since you never legally changed to your married name.  I think what will happen is they will just search your "married name" (that doesn't really exist anywhere) and there will be no hits on it.
