Withdrawing From AOS - Interview is Scheduled

Timeline

I have made a previous post regarding my situation, being that my interview for green card is scheduled but I am separated.

 

Came here on K1. Been married a year. AOS interview schedule for March 28. Husband, understandably doesn't want to go through with it.

 

I have no option but to withdraw my application. Is there a template letter? What do I say? How can I withdraw my application without it jeopardizing any future entry to the USA? 

I am the beneficiary originally from UK !!

I think I would make a letter with all your info and reason as of why you cancel your interview/AOS then I would take it to an info pass so I was sure they got it in the system before the date.

 

Has your husband withdraw the I-864 yet?

 

I'm sorry about your situation hope you will get back on your feet in the UK again can only imagine how hard it must be leaving everything and then come back to nothing again.

Future entry to the USA should be the least of your concerns right now, as it is in making sure you are safe and established back in your own country again. As I understand it your husband would need to withdraw the I-864, as he is your sponsor. It will need to be something in writing. You could make an infopass appointment. You can also go to the interview and explain your situation but you will be denied outright. I don't see any way forward for you, and I'm sorry. At that time you can remove yourself back to the UK. You will have done the right thing and honored your responsibilities. I would advise in this situation knowing the specifics of the other thread, and as others have advised you - to not only seek out a very experienced immigration attorney but an experienced divorce attorney. You have a limited timeframe here. As to what you could say, you must be honest about the relationship and the situation completely. He is unstable, you don't live together under the same roof or in the same state. This is a broken marriage. Have you begun divorce paperwork?

 

I can't honestly tell you if your VWP privileges would be returned to you, nor can I tell you, if that was the case, if you'd have luck with a visit visa etc. As I said, returning to the US in the future should not be your concern, above the rest of what is going on.

What is an info pass? No he has not withdrawn the i864. Im not concerned about my life in the U.K. I'll sort myself out. I just want to make sure I'm doing things right by the USCIS.

It a meeting in person with someone from USCIS.

I was hoping leaving the country would be easy!! So I can't just write a letter ?

I'm sure you can fedex it in with details go name, case number and so on and sign it. Also get your husband to withdraw the I-864 then because then the cause for sure goes dead.

Okay Try and start by calling USCIS ask for a tier 2 and talk to them. To make sure everything is being recorded on your case I would send a letter with all the details of your case and sign it to make sure they also get that one and attach it to your case. Then you have done what you can do and then move back home. Keep an eye for update on the webpage USCIS case tracker to make sure the case gets terminated.

You don't really *have* to do anything. You can just leave and let the petition die.

To simplify your life if you ever want to come back to the US, you can send them a letter with the case # asking to withdraw, saying you're returning to the UK. No lawyer needed.

This isn't what I'd like to do. I just don't want a ban. I assume I can come

back for a vacation in the future.

You can probably ask that of the Tier 2 person by phone or at the InfoPass in person.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hey! Sorry about your marriage...

As TBoneTX mentioned, make a call to USCIS, I guess if the tier 2 wouldn't be helpful,  you go alone on your interview and there make sure you wouldn't face ban later.:mellow:

I'll advice you to go to the interview regardless and explain to the officer what's going on. There and then you can put in a written petition to withdraw the i485. Or schedule an infopass prior to the interview with your field office. at the infopass they can usually give u advice on what route to take next. Good luck!
