Congrats it seems like cases from February are moving really fast compare to the ones from November and December! My I 485 still shows your case is ready to be scheduled

Pretty sure he's just extremely lucky and an exception. He filed end of February and there's been barely any of the January Filers who got their EAD approved yet. His file made it somehow on top of the other files and got processed. Highly doubt that means that the processing times will be faster for us :( Even the USCIS staff on the hotline say now that the average processing time for EAD varies now around 120 days. of course there's always hope ;)

Good morning everyone,

i have a question and I know you guys are great here and could shead some light. I know that when you receive an RFIE or RFE the process stops or goes back to zero whatever way you want to look at it. 

 

And this may have been answered already, but My my question is if you receive one for the AOS does that effect the EAD? We are filing from K-1. 

I-129F sent- June 15

Lockbox received- June 16

Noa1- June 20

RFE- August 23

NOA2- September 1

NVC received- September 13

Case #- September 13

interview- October 31

POE- November 13

Married- November 23

it depends on which from your RFE is linked to. A RFE on form 485 will not reset AOS or EAD.

His Field Office is Guam with AOS processing times of 90 days, so it's not fast processing for him but actually just average. 

People with field offices that have fast processing times tend to all get an interview even if it's adjusting from K1.

So i got my RFE in the mail today and i need serious advise

 

It says that my petitioner/ sponsor i.e my wife is income is considered to be sufficient but i mistakenly forgot to include her recent W2, pay stub and employment letter.

 

Now here is the kicker, I included a joint sponsor just in case and the same letter says his income wasn't sufficient. and ask for additional finicial documents or a new sponsor.

 

Now since my wife's income is sufficient anyway. should i send in her W2, paystub and employment letter and disregard the other additional document requested from my joint sponsor ?

 

Pls help!

I was hoping we don't need to undergo an interview, but this is better update than nothing. Interview date in under 60 days since they received the applications is not bad at all. I can't complain.

 

Guam is a little fast in processing, I don't know why, but my own N400 took 60 days from the day I submitted it until my oath taking.

 

This AOS is for my wife who came here on a K1 from Sweden.

It only took under 10 days from the "CASE ready to be scheduled" status to Interview has been scheduled.

Timeline

Notice that interview scheduling, and EAD seems to differ according to the type of adjustment of status. F-1 should be the faster, K-1 should be the second fastest, and the longest to take are the ones filed in the Chicago Service Center, which by default processes the AOS from marriage to US citizens.

 

AOS from H1B (married to US citizen)
2/02/17    Packet (I-130, I-485, I-765, I-131) sent in the mail to Chicago Lockbox via USPS
2/03/17    Packet arrives. NOA
2/10/17    Receipt notices in the mail
2/17/17    Biometrics appointment notice
2/28/17    Biometrics done

No change in status yet.

I am going to fax off the information tomorrow, as I don't have a fax machine at my fingertips (who faxes anything anymore?). Hopefully it is successful!

Good stuff, just got the update that my request was completed as well and a response was sent yesterday. Your response was regular mail too, right? When I made the request they asked me for both phone number and email address but it seems they mainly use regular mail for these things.

 

I'll be watching the mailbox like a hawk next week... :)

I received the letter in the mailbox and my response to it was via fax. I sent it yesterday and haven't had an update yet, though I don't expect one this soon. 

 

I will keep you posted on when I get a response, since we are both trying to expedite around the same time we might hear back around the same time!

26-Jan-2017 : Form I-765 Rejected because signature missing

 

6-Feb-2017 : Form I-765 resubmitted, and accepted at Chicago Lockbox

 

16-Feb-2017 : Biometrics Appointment

 for form I-485


 

3-Mar-2017 : Biometrics Appointment [Code 2] for form I-765

 

12-Apr-2017 : Interview scheduled. Interview date May 18, 2017

The rejection was for form I-765 (because I mistakenly sent it without the signature) but the AOS form was accepted, so the rejection wouldnt have delayed the AOS application anyhow.

There's no update on EAD since filing I hope they do send it within the 90 days.

And my local office is Chicago, IL.
