US Father refuses to give his baby daughter her US passport

Timeline

For the US passport, the father would have to sign off on it.  This was the case with my son's father (my loser ex).  The passport needed both of our signatures (we are both USC).  Your best bet is to contact the US embassy there in Kingston.  Hope this helps in some way.  Best wishes!

Parents have the right to possess their children's passports.  8 years old don't have unfettered rights to their passports.

   The father is using the passport in an attempt to keep the child out of the US apparently thinking that will keep the child from getting child support.  The rules about both parents signing off are to prevent removing a child from the US without the other parent knowing not to keep a USC child out.  A USC ( the child )  has a right to enter the US.  You may be able to get papers from the Embassy on the ground that the child is separated from their passport ( which is in the US )

This will not be over quickly. You will not enjoy this.

Actually, the US passport is the property of the US government, not the individual.  But, that's a moot point since it is, as others have said, most likely expired. 

 

The passport should not be reported lost if you know where it is.  You should file for a new passport (as a renewal).  You will need the father's signature on the application or a notarized statement from him agreeing to the application.  He cannot apply for a new passport for her because a) she is not in the US, and b) he would need the same authorization from you.  So, you can present it to him that you want to be sure your dauvhter has a valid passport for emergencies.

Not true.  My step daughter's mother still gets paid child support during the summer months that we have her.  He cannot claim her based on that time.  It's one or the other.

UNDER Jamaican law, both parents are responsible for providing for children under 18 years old, children living with disabilities, or a child who is under 23 and is still attending university. The Jamaican court makes it possible for a parent living overseas to file for child support from a parent living in Jamaica, or for a parent living in Jamaica to seek child support from a parent living in another country, providing that the country is a "reciprocating state".
