Look, your opinion is totally valid and I agree that forced child marriages are a serious human rights issue in many cases, and would even personally raise qualms about the oppressive history of marriages in Western states as well but.. I guess I'm not sure what you are trying to accomplish? Are you hoping OP shares the link with her acquaintance and somehow talks her out of a marriage she is already in? It's really hard to do much with just a vague secondhand account from OP. I definitely think you should pursue the cause if it's something you believe strongly in, but I don't necessarily think that this post is the best platform to do so.

It was to show that there is much work being done in Marocco (e.g.) as mentioned by previous poster. Many people were posting and I see uninformed posts about MENA countries all around VJ, so it was a "just for interest" as indicated by the "just". Didn't I myself say that the discussion was best fit for another forum? Which is why I withheld from the assumptious rant you just made against me. Thank you for validating also my right to an opinion.

Well the girl is turning 16 In FEB , The Guy which is her husband he is moroccan too and he is from her family and he is 23 years old raised in US and he has Citizenship and the girl is got married with consent of her legal guardian.

What is the norm there isn't always here in the USA, especially when your have to deal with Immigration.

It would be best if she was a bit older when they apply. Do you know if they have strong evidence of a relationship and marriage?

Was this an arrange marriage?, are they cousins?, I would kind of think so on the information provided, 15 years old VS 23 years old and such.

I know of one couple who were cousins, and yes from Morocco who were approved, but she was 18 at the time, he is not much older then her, maybe 5-7 years.

They are in US now, 3 beautiful children and very happy.

With regards to your first question... can a CR1 be done for a 15 year old spouse... this is purely a legal matter. Either immigration law allows it, or doesn't. Of course, the specific details of this situation may impact whether it is allowed or not.

She will have a hard time trying to figure this out from Morocco. If the husband (the US citizen) is in the US, I would suggest that he discuss the details of his case with an immigration attorney to make sure there are no issues.

I did answer the question on page one, however people would rather use the forum as a place to express their own personal beliefs then acknowledge it.

So here it is again-

In order for the Embassy to issue a visa- Your marriage needs to valid in the place it occurred and be valid in the jurisdiction you intend to live in.

So for them the questions are is it valid in the country they were wed in? Seems like yes. Will it be valid in the location they are going to be living in? I dont know. What state does he currently live in or is going to show he will be establishing residency in with his bride when she arrives in the US? Is it one that will recognize a marriage between a 23yr old and a 16yr old or not? Is it one that ALSO recognizes cousin marriages (a new piece of info just added to the thread). IF SO, there is no legal reason why the Embassy can not issue the visa.

The Officer at the Embassy will not have info on this. It is going to be the couples responsibility to provide the info on the states laws to the Officer to prove their marriage is going to valid where they intend to live. Its kind of messed up because one would think its their laws so they should be the one to figure out where you fall on the issue, but they take the position more like, its your case, so you have the responsibility to show US you are within the laws first, and we will then verify and check everything you say.

Once you prove to the Officer that the marriage will be recognized and will be valid in the jurisdiction in the US, its not a slam dunk that the visa must be issued, its just that is CAN be issued. You still have to prove the relationship is bonafide and not for benefits. This can be harder to do when it is a cousin relationship. When one party is also underage there can be questions of their maturity and ability to actually be a 'partner' in a bonafide relationship- so it may get denied for other reasons...

They need to check STATE laws. If they want a attny to help them, then get an attny.

Another question is whether a 15-year-old or 16-year-old can leave the country without her parent's or guardian's consent?

Well, given what we know about the emotional maturity and development of most 15-16 year olds (male or female) we should not throw our hands up in the air and say "it is not for me to judge"...it is perfectly ok to make a judgement in this case. Whatever our past practices were, it is clear they are not applicable today. If you want to move to the U.S. then you need to adopt our customs and laws and give up antiquated practices such as child marriage.

If older man/younger woman/girl marriage was banned then they'd have to delete the Philippines board on this forum.

Regardless, it isn't the opinion of anyone here - including myself - which is going to matter in this case. If the OP was legally married in Morocco and can demonstrate a bona fide marriage then the child would likely be able to receive an immigrant visa.

I've seen mature 15 year olds and highly immature 30 year olds.

That being said, I do not believe the most mature 15 year old in the world has the mental capacity or judgement to be able to consent to marriage at that age and be completely aware of what they are doing.

I know some here have a vested interest in trying to argue that this kind of dynamic is ok and that's their business. In the US and the western world generally though, 18 is seen as the age of majority and the earliest someone can marry under most circumstances.
