Not much evidence as hubby wasn't working

Hello everyone

I'm about to send my I751 package

My husband was a student when I entered US and he got a job just recently. We live with my in laws so all bills are under their name. We do not have any car or property under our names.

I do not have a lot of evidence but this is what I'll be sending

1. I 751 form

2. Copy of green card

3. 2 checks

4. Bank statement of our joint account (which doesn't have too much activity)

5. Birth certificate of our daughter

6. Pictures

7. Paperwork showing our visit to her doctor appts

8. Affidavit from my relative

9. Cover letter stating my condition and how I couldn't present a lot of evidence.

Anyone else who is in my boat and can help me figure out what more evidence I can present??

What about tax returns, insurance, DL there shows same address, credit card in same name, power of will, can't remember the name of it but when one pass away then the other one states as beneficiary, You must have some bills under you names, phone, insurance and so on??

Life insurance...

This is an area for debate but I lean toward explaining in the affidavit the reasons for (major financial) things you don't have. When I did my I-751 I thought mentioning the reason will "expose" weaknesses of our application to USCIS. But when I got an RFE for lack of financial evidence, I wrote carefully the reasons and circumstances that led to the lack of it.

I am doing my best in explaining my financial situation here in the cover letter..I really hope I don't get an rfe cus then I really have nothing else to provide

If you didn't file tax returns (you both are required to file) then you also need to explain why neither of you have filed taxes.

If you have time, I would wait to file your package until you have your medical insurance.

Your explanation letter should explain your situation, not apologize for your situation. Make it factual, not apologetic.

vbtwo Thank you for the clarification; I won't split hairs on the law. Personally I think you should file no matter what, as it shows your sincerity of proving you are financially joined, living in the same roof, and are completely transparent. Make better sense?

This is true - but what I meant was that the OP needed to explain in her cover letter that she and her spouse were not required to file, as there was no need to do so because of no income.

How about having your in-laws write a short letter, explaining that you have been living with them, and that they have been paying the utility bills? That's what my husband and I did. Also, medical powers of attorney could be helpful and are easy to set up. Do you have a car or car insurance in both your name? Any bills showing a joint address?

Your case is quite a stretch with the lack of commingling evidence.

I think when you are in any form of immigration process, you MUST leave a paper trail. So that you will have something later to help complete your process.

Other than the words of your husband's family, there is no proof to establish that you actually live in the house together with your husband or that you even lived together.

It wont be a walk in the park, so get an explanation letter to this effect.

I think your daughter will be your biggest evidence so make sure to include lots of pictures that can tell the story of your lives together.

Just as a note, I never worked while married to my ex, but we always fixed joint Tax returns.

It sounds like you're going to be needing lots of letters.
