Bigamy - Potential issues later

Hi there,

My wife and I are divorcing, and I am already in a relationship with a woman from Indonesia (please don't judge. My wife is fully aware and this is a result of her cheating). Now I'm not sure how long the divorce will take, but if I marry this other woman (polygamy is legal in Indonesia. And to cover this base too, this woman is also aware of my situation in its entirety), before the divorce is finalized, will I have any problems when I petition her later once the divorce is done?

I believe you definitely will. You can't be married to two people at same time per US law so your second marriage will not be valid.

Polygamy is illegal in the US, and your marriage will not be valid and petition for spouse will be denied.

Yes you will. The marriage will not be considered legal by US standards; you would need to return to Indonesia and marry her again, legally, for it to count. Even then, it would be a red flag. Why not just hold off, or perhaps have a engagement ceremony now, and then the proper legal (and religious, if you want) wedding once you are free to marry by US law?

Only a first marriage is valid for the purposes of immigration. You must wait for your divorce to be finalized before you can marry your fiance.

I will add to what others have already mentioned, yes, you need to finalize your divorce before going ahead and getting re-married - AND - must have the divorce decree in hand before doing so!

Example, I was granted my divorce on March 11th (court), but had to wait for the divorce decree and it took a few weeks for it to get to me, not only that but the actual divorce date on the decree was not listed as March 11th, it was noted as April 8th and logged in the records as April 8th. Yeah, fun fun fun!

You have to make sure you are "totally" divorced before getting re-married otherwise you are not only going to get denied, but will probably create an uber red flag for your case.

Of course you will have problems if you don't wait until you are divorced. If you want to immigrate to the US then you must obey US laws. If you want to have 2 wives then stay in Indonesia.
