So am I right in thinking a NOID is on its way? My fiancé has been looking online and just informed me, and I hate to say it, but it's out fault. We didn't know we had to submit anything but I-129F and the check so I'm assuming they will be sending either NOID or RFE to gather the evidence we failed to produce. If we send all evidence, will our application be processed as normal?

From what I can understand - yes, if you send everything they ask for you'll be alright. But it seems like with a NOID you only have 30 days to do so. The OP of one of the links I posted had done the same mistake as you guys, they only sent the forms and check and nothing else. But that was recently so I don't think they have an update on their case yet.

That should be the case but I believe it would be up to the person that is reviewing your packet. If given an RFE and able to supply the information that was missing please look at the information on this site to see what information should be submitted with your I129 petition its certainly more than an application and a check. It is very helpful. Good luck!

Today I checked our online case status and was greeted with this message...

NOTICE EXPLAINING USCIS' ACTIONS WAS MAILED

On June 6th, 2016, we began reviewing your Form I-129F, Petition for Fiance(E), Reciept Number WACXXXXXXXXXX. We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice by June 20, 2016, please call customer service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

Can anyone help with what this means? I've tried finding some positive info on this site and all over Google but I keep finding posts that say it is a NOID (notice of intent to deny) yet I can't imagine them wanting to deny us at this stage. I worked in the US for 2 summers and my fiancé is a police officer. Surely that must stand for something to show this isn't a fake relationship.

I had the same thing and it is a NOID.. but have no fear, you have 30 days to overcome it and i successfully did!!!

it could be a ban on overstay? material misrep? criminal background? those are the most common.. good luck! i would get a lawyer for your NOID or ask around and figure it out!

Oh, and i had the same letter and it was a NOID and i never received an RFE before and you have 33 days to refute it from the date of the letter... i got my letter super quick so expect it today or tomorrow in the mail.

think of something you did? perhaps overstay the J1 visa? or did you leave a job off on your application? also, so cute you guys met on mackinaw island! that place is the best:)

we got the same notification on 23 May, when we received the letter, it listed out what we needed to do. It was a NOID but with instructions. They wanted a statement about some J visa and residency requirement So we went ahead of provided this.

We also talked to Tier 2 before we did it... If you are near an infopass office, i would highly suggest you book an appointment. We are 5hrs from our nearest Infopass so it wasn't an option.

We are still waiting for the outcome as we provided the information this past weekend.

I might be totally wrong here guys, so please do correct me if I am, but isn't a J1 holder required to stay 2 years in the home country after return and could that possibly be causing all the fuss too? As I see from the profile the J1 visa was used in 2015.

Not all J-1s are subject to the two year home residency requirement.

From reading all of OPs posts, it's clear that the NOID was issued because the OP failed to follow the I-129F instructions and provided no supporting documentation whatsoever, only submitting the I-129F and the payment to USCIS. In this situation, a NOID is a no-brainer.

First of all, I can't thank everyone enough for the information being provided. I would be lost without this website!! I'm feeling a lot more confident that this problem can be fixed now after all the helpful comments, much more so than a simple "NOID" answer where I was fretting about being denied!

My fiance and I are trying to beat the letter in the mail by gathering all possible evidence that could be required so that when the letter arrives, we are ready to mail required documents that day.

Neither me nor my fiance has been married before, we're only 23 and 25. I never overstayed my J-1 visa, I worked for the legal time required, paid and filed for my taxes both years so I can't imagine that being an issue, but I will check out the requirements on the 2 year home stay. That would be a bummer!

If you only send the form and check without all the other required documentation, they will either outright deny it, or some adjudicators will give you a chance to send in all the documents you failed to provide. Just get them all ready in case you have 30 days to avoid a denial.
