How can you file taxes without a Tax ID number an EIN number or a social security number.

If he had one of this. He was not working under the table. If not by which way he filed taxes without any identity.

There is something called ITIN.

He has a social security number. It is not for use for work, as printed on the card.

How can you file taxes without a Tax ID number an EIN number or a social security number.

I think you have no clue what's going on here. People say something and you then say the same thing but in a disagreeing way. She just said his social security card says he can't work. A social security card is not a work permit.

My friend is engaged to a guy who has been here since 2012 and has been working under the table. I know all about AOS, as my husband and I have been through the process and he is now a citizen. However, I don't have experience on how to handle this. What needs to be done in this situation?

If you know about AOS then you know that USCIS, and DHS will care only about employment, filed tax returns of USC, and if USC meets poverty guidelines.

Also what's his legal status here since 2012?

Best to get a good immigration lawyer AND a good tax lawyer - or at least a CPA with appropriate experience. Here's one that is very, very good. Just an example: http://www.lancedrurylaw.com/

The "under-the-table" work will likely surface - now or later. It's far more serious if he made significant amounts of money and has a tax bill. In any case, he needs to clean it up and get straight with the feds. Most tax issues are forgiven, but only if you come clean and pay (if necessary). I went through some issues with the IRS and everything went OK. Good luck!

  • Taxes: Tax law does not care about legal or illegal income. All income is taxed the same way. If his income for a particular year was above the threshold for filing taxes for that year, then he needs to have filed tax returns. (And if he failed to file, he should file now.) You did not indicate whether he filed taxes properly for that income or not; people are advising that he should make sure that his taxes are filed.
  • Immigration: You did not indicate whether your friend is a US citizen or not. If your friend is a US citizen, and this guy entered legally, then they qualify for Adjustment of Status, and being out of status and/or illegal employment won't affect the case at all. So in this case, he has every reason to be 100% honest about all his employment when asked.
    • Another thing is to make sure that he has never claimed to be a US citizen; his illegal employment raises the question of how he was allowed to work. Was his employer complicit or negligent and didn't ask him to fill out an I-9? Was he working as a contractor so he didn't need to fill out an I-9? Or if he filled out an I-9, what did he put on it?

His social security card says " not for work "

what does it mean for you? Not for work mean what in English.

the guy doesn't have a work permit neither.
