Hello all,

I am a USA citizen residing in Hawaii.

My girlfriend is from Japan, and she is on a 6 month student visa.

Is it possible for me to "marry her" within the USA (whether it be Las Vegas or another state), and "change" her visa status? She insists that her girlfriend from Japan did something similar to this, but I am very skeptical. I told my girlfriend, if it was that easy, than millions of foreign nationals could stay in the USA by just obtaining a student visa.

There is also the subject of pregnancy, and citizenship; but that is for another time. Right now, I just want to know what the visa would be changed to- she told me it is called a "F-1 STUDENT VISA".

Yes it is possible.

They have to get students visas, find someone to fall in love with, and marry, and prove their relationships are not solely for immigration purposes. So a little more complicated.

You would marry and file for her to become a Legal Permanent Resident.

you would have to marry her, then both of you will just have to file for adjustment of status. Since she's here already, it might about 6 months for all that's. And she might have to do other steps after she gets her 2 year green card to her 10 year green care then to citizenship. It requires dealing with immigration for a while. Be careful she's not just after the GreenCard. Good luck.

Sorry, she is *currently* on a F-1 student visa; she claims that the status of the visa can change due to marriage. But how does one go about doing this?

What is the specific name of the visa it would "change" to? Can someone give me some information about this, and what the process is?

no, her visa doesn't change, but she will adjust status and get a 2 year GC

this is because she entered legally in the US and marries a USC,

but be careful because if she had immigrant intent, meaning she lied in her interview for the student visa, it could be counted as immigration fraud

OP, i let me get this straight:

1. you are a US citizen

2. Your girlfriend is a F1 student in the US

3. You two want to get married and live in the US

4. She is pregnant.

Correct?

If it is, then: you get married and file an adjustment of status along with a petition for an alien relative - see a link to a guide provided to you earlier. Process takes about 5 months and you will need proof of your relationship like photos, bank statements and, of course, a doctor's note about pregnancy and maybe an ultrasound. When this is done, she becomes a permanent resident for 2 years. At the end of 2 years you will have to apply to remove conditions, which is to file I-751 and prove your family is still a real family.

It doesn't matter where in the US you get married, as long as you are married.

Contact the consulate and tell them about it right away. We had my husband's name spelled wrong in the DS-260, contacted the consulate and had it corrected before the interview. And don't hijack the thread please :)

My immigration journey

July 2009 - F1 student PhD program

AOS
June 2010 - married USC

August 2010 - sent I-130 and I-485

December 2010 - CGC received.
December 2010 - ex-husband got crazy
May 2011 - separated
November 2012 - divorced!!

I-751 waiver

October 13 - filed I-751 waiver by myself
November 28 - BIO & InfoPass to submit a divorce decree

December 2012 - CGC expires

May 3 2013 - RFE received, asked for a divorce decree (haha) and address clarification + more evidence

July 6 2013 - RFE mailed and received

September 2013 - InfoPass, passport stamped to extend my status

November 2013 - Finally an interview is scheduled
December 12 2013 - Interview. Approved without any questions, passport stamped. Same officer who did my initial interview (I was told "I saw it coming, don't give up on love" :) )

December 27 2013 - Card received, too bad I was overseas

January 2014 US entry, special screening, but admitted instantly once I got to speak to the officer. It's a standard procedure if no valid GC on hand.

July 2015 - MARRIED in Russia

N-400

October 2015 - N-400 sent

February 2016 - interview and test

March 2015: USC!

DCF for my husband

April 2016: InfoPass to file I-130 in Moscow, approved on the same day.

May 2016: DS-260 interview - AP for "dangerous" work field

July 2016: visa issued! 59 days in AP.

May 2018: filed I-751 

June 2018: 18 months extension received

I traveled all over the world in the meantime, no problems with visas and entries, occasionally some explaining and more documents to haul around.

We've talked about starting a family; and even though we've been "trying", no success yet.

Funny, I was just talking to a local friend, and his wife is from Japan. They have been married for 8 years. He said she was on a travel visa, and they married in Hawaii, went to the (Immigrations office?) Got interviewed, then they went through a long process, and she finally got her green card. He was very vague after the "Married for 8 years part,, " and stated that he and his wife have no children of their own.

So, no one really answered my original question: what is the technical name of the "changed visa"? Is it then called a "K-3" from a "F-1" (student visa?) Who do we need to contact? I saw a link that had some very informative docs that I need to fill out; I have small experience with a K-1 VISA and am proud to say, that, albeit I never married that woman 3 years ago, I did it all by myself, and the process took roughly 9 months with 1 RFE.

I just hope that, that previous K-1 application will not hurt my chances in any way to file a ......"K-3?" Visa with my present girlfriend.

Thank u for that answer, "permanent resident." So she can stay in Hawaii for as long as she likes after filling out all those forms that the other person wrote? like the I-130, etc.? Do we both have to get interviewed? This process sure seems a lot more "easier", however, my K-1 would have only taken 9 months or so, barring one "RFE", and again, I am proud to say I did it myself without the help of a lawyer. I just need the step by step instructions, as my marriage (tentatively, hopefully, - I haven't proposed - yet) is completely legitimate and true.

I just went through this with my husband, you can check my signature.

It is filing bunch of form, status adjustment , petition, and etc.

She will get a conditional green card because you have married for less than 3 years , then after 2 years you can apply for the normal GC. If you divorce before you apply for the GC under 2 years I think they remove her card ( don't quote me on this). You can apply for USC after you have the GC for 3 years ( including that conditional 3 years)

There are guides on here, if it is too complicated hire a lawyer to do it.

You both need evidence of your marriage, start taking pictures, adding her to bank accounts and etc

Husband moved from SF to NYC to be with me for a year before marriage.

Dated 2 years,

2010- On F1 student visa college NYC

2013 - met husband online playing FFXV Arr FARMING became BFF

6- 9/ 2014 - he confessed and started to date (L)

11/24/ 2014 thanks giving we met for the first time ( flew back and forth)

3/15/ 2015 he moved in <3 :luv:

7/ 2015 - 7/2016 OPT issued

10/7/ 2016- Fiance proposed with my dream ring <3 :dancing:

Started to prepare our documents

12/28/ 2016 Mini moon ( went to hawaii to meet my inlaws)

1/ 8 /2016 got married in NYC court house waited for my mom to fly over to witness us :goofy:

1/22/ 2016 Filed and sent my documents ( don't ask me which one, my lawyer did it)

2/ 4/ 2016: Cashed the check

2/ 23/ 2016: bio metric appointment

3/ 15 / 2016: " As of March 15, 2016, we are ready to schedule your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number XXXXXXXXXXX for an interview. We will schedule your interview and send you a notice. Please follow any instructions in the notice. If you move, go towww.uscis.gov/addresschange to give us your new mailing address."

4/ 4 / 2016: EAD/ Advance Parole issued

4/ 18/ 2016: received my EAD card physically and Advance Parole in the mail box

We are having our wedding in Canada because my mom is going through chemo therapy and my wedding planner told me it would take her one year to plan my wedding =/ and get the venue I wanted.

My lawyer said it can take up to 6 month min for NYC office he predicted August 2016 for me and the worst October 2016 for interview,

Our evidence:

- ​e ring receipt, Wedding ring receipt, wedding dress/ suit receipt, wedding venue receipt/ wedding planner/photographer videographer contract signed

- I owned my own home so I added my husband to the title , we are also purchasing a new home together in SF under both of our name ( he is on the contract of purchase)

- Health insurance and Home insurance joined as beneficiary

- bills are joined in names

- we co own two adorable fur babies..

- state id same address

- 4 joint bank accounts

- many photographs of selfies together ( hopefully they count)

- Plane tickets before he moved in flying back and forth. Also vacation tickets

- we have matching tattoo , we got them after proposal ( will submit photo)

I guess, I will have to research more about which steps is first, --as I do NOT want to use a lawyer.

I did the K-1 Visa by myself, and would have gotten married, so I feel confident I can fill out the required forms on my own.

Gonna go out on a limb here and guess that I have to marry her first, then, fill out the required paperwork, then, apply for "permanent resident" status.

I have tons of texts, photos, again, she is living with me for 6 months (still. currently.) I guess I will propose to her soon. She's definitely wife material. At my age, I ain't got time for no games or wasting my (or anyone else's time.)

Thanks to all for your invaluable input, I guess it is (easier) to go this route for "permanent resident" visa than the K-1....I will do more research and ask around, I know a couple of people (not close friends) who have a similar situation....
