Extremely Bad Interview Experince - Fairfax, VA

cwhetstine, I feel sorry that it was so bad interview. Yeah it certainly seems like this interviewer had something against you in the beginning but you know, it's not anything what didn't happen to anyone else. I've read about cases when AOS interview was very harsh for people and interviewer was rude and offencive to start with. May be it's a bad luck. May be he really didn't like something from your past like people mentioned before, but that shouldn't affect his decision if he is being professional.

We quickly started off with our ID's, her SSN card, my tax forms and joint accounts etc.

What kind of "etc" did you have beside joint accounts and photos? You need at least few different supplements, like utility bills in both names, family phone contract, insurances in both names, car title in both names - basically few different pieces of paper issued by 3rd parties showing that you share financial and other respobsibilities. It would also help to include a few affidavits from US citizens who know you well as a couple and can write it for USCIS. Hopefully you'll get RFE to send them more evidence of your marriage and be sure this time to send them every piece of paper you can gather, even if it's something like electric bill that shows your both names and one address.

based on what you (OP) wrote, (a) the IO is a complete (you fill in the blanks!), (b) your military service has no bearing on the relationship, © your reasons for leaving the military are none of his $#@$% business, and (d) I don't see any red flags whatsoever....similar age, long term prior to K1 relationship, etc......this guy (IO) is from another planet....did he even give you a piece of paper defining whatever alleged defects your case has? Since this clown is doing business in the US (as opposed to an embassy overseas), I think you can (should) return to speak to his jefe, to get a clearer picture of what exactly is going on....

First red flag I see and it isn't related to immigration at all. You were honorably discharged after ten years. Most people if they stay past eight, why get out at ten when you are only seven or eight years from either an early out or retirement. He, being prior military, probably started speculating that something happened during your career.it could have been a medical discharge but you wrote honorable. No doubt he had your 214 though.

I love how you say "only seven or eight years" as if it's nothing. That's almost as long as he had already served? Last time I checked, the Selective Services draft is not in effect currently so military service is not compulsory. If the interviewer had some issue with him collecting veteran benefits (as a veteran by all accounts, mind you, even if he didn't stay those extra years) then he should take it up with his employer, aka the U.S. government on their criteria for who can receive benefits. The job of the interviewer is to determine whether or not the marriage was bona fide. Nothing about his honorable discharge should effect that considering from OP's description, it definitely seems to be so.

OP I read this thread to my husband last night, and we both felt very bad for you and wanted to encourage you not to despair. I did a little bit of searching around about this particular office.. and there are several mentions of an individual there that sounds very similar to how you have described. It may be the same man.. and if that's the case, it could be how he behaves in general. That being said, I do think it has something to do with his scrutiny of your military history, of which has no bearing on the case but I can imagine numerous very arrogant and ignorant reasons he'd have a chip on his shoulder about it. You have served your country honorably. I would hope that there could be some recourse of complaint..

Whole heartedly agree. Despite me and my husband having a history together spanning back to our childhood, my one fear was that when we attended our AOS interview and end up with a complete A.Hole like OP did.

OP, I would suggest taking HFM181818's advise....

Did you read where I said it isn't fair or right but probably what happened. There is a culture in some people that if you don't serve full term and leave at an odd time, that something (usually disciplinary) happened. It has nothing to do with collecting military disabilty. Many collect disability. I am betting on that it is the odd time to get out. Again, since the interviewer has to operate under the law, that is why I also said that the OP is only DELAYED because at the end of the say, the law should prevail.. and that he has recourse as a veteran.

kind of what happened to us. the interviewer focusing on the USC. my in laws were asked to come to the interview as well. its crazy but we didn't get called for ROC interview. just take it like a grain of salt and wait to see what the letter says. whatever they ask for prepare and submit. this is a frustrating process.

There doesn't always has to be a reason why a IO acts like an ego filled jerk who enjoys scaring applicants. Some just are like that for no reasons

other than they aren't getting any whatever at home or woke up on the wrong side of the bed

and some like to see more evidence than others. This whole spin on the military time being the factor is bizarre.
Depending on what the letter says file a complaint for rude treatment.

I am sure you will eventually be approved and there is no reason to be afraid of being separated, like I said in case of denial you simply file again, no one

will bang your door in and haul her off. It won't come to a denial is my educated guess.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I am sorry you had a bad experience. Hopefully you will hear something soon, whether an RFE or approval/rejection. Also look on the bright side, at least you didn't have a Stokes interview, although it might have felt like one.

I feel sorry for you at the same time furious.. I think I would probably file a complaint. I think you'll get RFE. Gather all the things like Bills, credit card statement, beneficiary 401k, health insurance. Pictures of your wedding all those stuff. Maybe you can get an affidavit from the people who both know you in the US and have that notarize. Good luck. Tell your wife, things will get better. Hugs from a fellow Asian.

Well, I don't usually write here. But I have learned my lesson - if you don't complain about them, they will get you. I would go back to that office (I live in Alexandria) and complain about this guy. America is made out of immigrants and his parents/grandparents may not even be American. This is so unacceptable, do what you can to support your wife, and again, I had that issues with this office, once I complained about the service I received from one African American woman, I complained, and it was all done in a minute by her supervisor.

I got a feeling IO didnt like 10 yr honorable discharge and a 50% disability claim. There is definitely a bias already.... I am sorry to hear that. IOs should focus on the relationship, not on the trivial things of things prior to relationship if its not criminal.

most veterans claim disabilty (now adays at least or greater than 30%) . you can't work 14-16 hours in hazardous situations without either: hearing loss, vision loss (including shrapnel), loss of range of motion, etc

veterans deserve their disabilty regardless of the years, so I am almost positive that it wasn't the disabilty claim. THe IO was probably disabled himself. so I am thinking it has more to do with the years opening up questions.
