Hello!

Hope you're all doing well and that somebody ca clarify my confusion.

Background: hubby and I filled I-130, I-485, I -131 and I-765. Hubby( sponsor) does not make enough money so my sister in law is the Joint Sponsor ( apparently, love is not enough lol).

On Dec 28 I had my Biometrics taken. One week later I got a creepy, yellow letter in the mail ( in my country,yellow is considered a funeral color ):

"Request for Initial Evidence ( I-485)

( skiped all the scary intro about the "failure to do so will result in denial")

-The joint sponsor lists their current income on Form I-864 as an amount to be considered as sufficient; however, no evidence has been submited as proof of current income.

Submit evidence of the joint sponsor's current income. Such evidence should include:

Letter of employment, pay stubs for the previous 6 months.

-Submit all supporting tax documentation ( W-2s, 1099s, Form 2555, and all supporting schedules) submited to IRS for the most recent year.

Based on documents submitted with Form I-864, Affidavit of Support, for the joint sponsor, the income did not meet 125% of the poverty guidline for the joint sponsor's household size.

Submit evidence of assets ( and there goes a long list of what evidence of assets include).

If you decide to obtain a joint sponsor they will need to:

File form I-864

Provide copier of their most recent Federal income tax returns

Provide copies of all supporting tax documents

Provide evidence of their staus ..

Note: The total income (line 22) on IRS Form 1040 is used to determine qualifying income for a sponsor, not the "Gross Receipts" (line 1) from IRS Schedule C or C-EZ."

Questions:

My Joint Sponsor makes about $40 000 a year, which is more than the poverty guideline. She is divorced and has no children. Why does she need to subbmit evidence of assets, along with the letter of employment, pay stubs and tax docs? We also mailed some w2s and other 1040 along with the I-864 for my Joint Sponsor but USCIS asks for them one more time. Also, we need to mail all that proof only from my Joint Sponsor, and not my hubby, right? The final Note is pretty confusing too.

Thank you for everything. You site helped us do all the paperwork without a lawyer and I do hope that I can get some advice on this one too.

there are 2 sections on the I-864 -

one for prior year income, gleaned from tax data

and

current year income.

Current year income proof was not submitted, and the details of what to show was listed in the letter.

Focus on that.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

hi

assets aren't needed, but as said, she didn't send any proof of current income, such as copies of several paystubs, and letter of employment stating, company name, job position and how much she is currently earing

they are only requesting joint sponsor, not sponsor

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thank you so much!

My Joint Sponsor will get me a letter of employment and pay stubs for 6 month, also we will fill for the tax transcript for the previous year with IRS. Hope this will be enough.

My situation is very similar to Consalice's.

Will you be sending tax transcript for the 2014 tax year?

also, would pay stubs for 4 months be enough? My husband is my sponsor. His income is considered sufficient, but he only started working 4 months ago.

I would really appreciate some help!

Hi! We are in a similar situation, my wife can only provide 3 months pay stubs. Did you find an answer to this?
