I would for sure divorce him here before going back to the Phils., as getting a divorce there is next to impossible.

Confront him, "and tell him what you are going to do".,.,., a "face to face confrontation would seem a must in this situation!"

He might get a dose of reality, and do the right thing, BUT.,.,.,.,""DO you really want him after this?""

You have some hard decisions, and I feel for you. Please, keep us posted, and best of luck.

By the way, the K-1 was totally useless, the minute you came through immigration at your Port of Entry. You are here on I-94 now, I am pretty sure.

i feel so sad after reading the topic here, OP the best thing you can do is file a divorce and go home. He is not the right guy for you he sound so selfish and stupid, you're like a prisoner that's absolutely emotional abuse. If he really love you he will never let you stay in the US illegally especially that you have a son. So don't waste your time file a divorce and go home.

I do not have work coz I can't yet. Trying to get some projects that I can do and earn some. No savings no money even for the plane ticket. Husband says he will take care of it and would even give me some funds to start a new life. I don't know where he would get funds and i have been waiting. I assume there is really no funds

Sometimes, a foreign consulate within the U.S. can help to repatriate its citizens. Consult the nearest Philippines consulate. Charity organizations might help to provide some funds for your return tickets.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Dear this doesn't sound like a good husband. did u get to know him be4 u marry him? He brings u here thousands of miles then get u all stuck? He never looked at the paperwork to see the requirements? He was trying u out now he wants u gone. keeping u here illegal with no freedom to work or to be independent? I wouldn't spend one more day thinking about him. I hope he has the decency to buy u a ticket to return home safely. U will find someone else who really loves u. Did u display any behavior that would indicate to him that once u get your gc u will leave him? Just tryin to figure out why he would act this way.

You are just listening to one side of the story and claim, Would be nice if we would know his story. He was so determine to bring her over on K1 visa. Spend his money, time and so on and now he changed his mind?

Maybe it could be some other reason. God knows.

First of all, Do everything possible to be charming as you were, when he filed K1 for you. Hope everything works out for you. If not please go back hope to prevent your life and your child life for been miserable. Because its not easy been illegal in US specially with a child. Also prevent your self from 3 year ban from entering US again and very little and no possibility be legal ever again if you overstayed.

If you work out with your hubby its perfect, if God for Bid not, Then leave and you might have another chance to come back again on K1.

I would be seeing a psychiatrist and a psychologist by now. He doesn't get to abuse you and just walk away unscathed. He's a grown up and he needs to learn that there are consequences for his actions. Just my 2c. I see everyone else is telling you to run home with your tail between your legs.

I am really sorry that you are going through this, especially with your son to worry about. More than anything you have to look after yourself, and do what is best for you and your son. To me it sounds like your 'husband' didn't logically think the whole thing through. I would head home if I was in your position. I know it can be hard and scary, especially as you have already packed up and moved your life half way around the world already. Going to, or contacting, your local PI consulate maybe be the best situation as they might be able to help figure out a way to get you home.

Also, considering that he is more willing for you to go home than to sign the form I would take that as a sign that this isn't going in the direction you hoped. I hope everything works out for the best for you and your son, whatever you decide.

If he refuses to sign even after speaking to an immigration lawyer your best bet is to file for divorce and go on with your life. He is not the husband you would want for yourself nor the father figure you should wish for your child.

I agree 100% he obviously doesn't want the responsibilities if he did he would sign.....I would of gotten the message and filed for divorce the first time he refused...It is sad that he up rooted you from your home and then acts like a jerk after...DIVORCE him and take your son and go back home to your family....You don't need this kind of heart break, if he wont sign now he never will....

From what has been stated thus far, the OP has not been abused. Her husband changed his mind. Sucks, but it is his right.

Recommendations to leave the US are based on understanding she has no recourse with immigration without her husband's cooperation, she cannot force her husband's cooperation and best protecting her/her son's interests for future opportunities.

While I have not met the OP, I suspect she doesn't have a tail :)
