You can file the day after you got married as long as you have a certified copy of your marriage certificate.

While you can file the day after, you'll be issued a conditional visa (CIR1) that is for people filing who have been married less than two years. If you've been married more than two at the time you apply, then there are no conditions.

There's additional filing you need to do. Maybe someone who has more knowledge can reply to you to explain in more detail about the CIR1 visa. I was married to my husband for five years before we applied so the conditions didn't apply to us.

You can send the I-130 as soon as you have the marriage certificate in hand, unless the wedding was by proxy in which case you must wait for it to be consummated first.

Also make sure the marriage certificate you have is certified by whatever authority is responsible for that in the country it's from. The original signed certificate may not be enough. You might have to wait some time until the certificate is actually registered before you can proceed.

Important semantics need to be corrected in the following posts:

Cr1 can be filed right after ur marriage. IR1 can be filed if u r married if u r married for 2 yrs plus.. Hope this helps

IR-1 is not "filed for," it's a visa that is granted if the beneficiary has been married to the petitioner for period of greater than or equal to 2 years. Furthermore, it is possible to obtain IR-1 status on a CR-1 visa if the beneficiary enters the US on or after the date of their second wedding anniversary.

me and my husband got married april 2013 and the following month my husband applied I-130 and i got now my visa under CR-1

An I-130 is a petition form that is filed, not something that is applied for.

If I understand the OP correctly, this is my take on the question:

There is no time frame you have to wait to file for I-130 petition after your wedding date. But my lawyer told me to wait at least a month after the wedding before you file I-130. He said that USCIS freaks out and think its a fake marriage if you file I-130 petition right after getting married.

Most everyone I know who has gone through the process has filed within one month or less of being married. Some have their visas some are still waiting. It depends on the case but most file immediately after getting the registered marriage certificate.
