If anyone help me regarding about filling K-1Visa. I've gathered just about every requirement that is needed for filling K-1 visa except the Fiance Letter of Intent. I am doing/filling it on my own. Is it ok to send the K-1 form now even without the "Fiance Letter of Inetent?" I still need to make one for my fiance, have it sent to her so she could signed it and doing this will take about at least a month. Is it ok to send the K-1 form now so that it can be processed and will I send the "Fiance Letter of Intent" when it's completed?

You need a original G-325A and the Letter Of Intent from your fiancee for the I-129F petition. No sense sending anything in without all the requirements. You can not send in the missing documents later, you would have for wait for the RFE from USCIS to send those missing documents in... not the best idea.

You can email the letter to your Fiancee, she then needs to print it out, sign it and mail it back to you, along with a complete G-325A signed and dated.

If I were you, I would not take a risk not send Letter Intent of Marry that could delayed the process. Better be late rather than sorry. Indonesian post office is well known for being not reliable and my then-fiance (my now husband) received my package including Letter Intent of Marry less than a week. Use the best courier company in her country. I believe in the Philippines they also have FedEex, UPS, or DHL.

Is USCIS really that particular about an original versus copy/scan? I submitted the original signed G-325A but a copy of the letter of intent from my fiancee.

They state that for the forms (G-1145, I-129F, G-325A) they need the originals ("wet-inked") and also for the two Letters of Intent. All other documents can be (good) copies, but be prepared to be able to send/show them originals if they ask for it..

If you fail to include the fiance letter of intent, you will get an RFE. Wait for the letter and send it with the rest of the stuff. Your fiance does not need to author it; you can do so as long as he/she signs it.

I authored Candy's letter of intent and emailed it to her. She printed it and mailed it back to me along with whatever else she needed to sign.

Black ink is fine. Candy used black ink and nobody ever questioned it.

It was the first thing I've email to my fiancée knowing from the get go that the letter and the G-325 would take the longest (snail mail method). So have her get that out of the way and ask if any questions.

My fiancée sent the letter and form over the weekend via express. I got it yesterday and send out the whole package this morning.

Went on the USCIS website today to find a Request for Evidence was sent out 7 days ago but have not received it. Is a Fiance Letter of Intent mandatory? Had a lawyer do the paperwork for us but never saw or signed this letter of intent. I'm going to see her in 11 days again, she lived here with me for the time allowed and I lived with her in Brazil for four months. I think that alone would show intent. This is all very frustrating. I forgot to add she is in Canada right now, has duel citizenship.

Fiancé(e) letter of intent is mandatory from both parties, one from the petitioner and one from the beneficiary. They are a typed letter stating you will marry within 90 days of the beneficiary's entry to the U.S. Your Lawyer should have requested this from you both.

When you say she is in Canada, and has U.s. dual citizenship, is she the beneficiary?! If so, why are you applying for a K1??!?

Also, please fill in your timeline!

She has Brazilian and Canadian citizenship.. Sorry, I was unclear about that. We've been dating for two years. First time she came to the US for a week, a year and half ago. Than she went to Canada because her adopted kids didn't want to live in Brazil anymore, they wanted to stay with step dad in Canada. Then she came back to the US to live with me for a few months. We went to immigration in downtown LA to extend her stay. Was told they had no record of her being here and to leave and come back making sure her passport was stamped. She did and they said no, she needs a visa. I flew up to Canada then we flew to Brazil together where I stayed with her for a few months and came back home. I'm a total rookie at all of this stuff and after looking around on the internet, saw that she needed to be out of the US for 6 months or a calender year. I flew back to Brazil to spend the holidays with her and her family. Found out I had cancer on that trip and needed to come back to the US and have half of my left kidney taken out. When we arrived at LAX they told her no, even though she had a plane ticket to go back to Canada so she could get a copy of her divorce papers. They flew her to Canada and every few months I go there so we can see each other. Everything has been documented with pictures, plane tickets, emails, Skype.

Depends on the adjudicator that gets your petition. Some get an RFE for not having an original signature, and some do not. You could be fine.

Ok.. so if an RFE is on its way all you can do is wait for that.. comply by having her sign a copy and you can in turn return it to them ... not too much of a delay... all the best !
