Hi Fellow VJers!

I've read the post about this and it says it is a common issue for new immigrants. I have been here for 2 months and 1 week and got 2 job offers (probably 4 but I am not sure). The last job used a 3rd party company to check my background but they said my SSN comes back invalid so I am now waiting for the paperwork they sent me which is the result of the background check.

My questions are, is there anyway to avoid this if the company uses 3rd party people? What else can we do?

I informed the company that I have my gc and my ssc as well as my NBI that was one of the requirements from NVC and the USEM but they didn't bother to look at them and just relied on the background check result. I called SSA and they told my my info is correct and I am on the system.

Due to the new format of issuing SSN now, some of the old software will not work correctly and returns that the SSN is invalid when in fact it is a problem with the software. If this is a job you want, then fight for it. If this is just a job and you really do not care about it one way or the other, I would inform the employer that there background checks are not working with people with new SSN, they are missing out on prospective employees, like you, and move on.

Thank you! I tried fighting for it but the employer didn't respond so what am I doing now is telling the employers about those 2 job offers and informed them that I have all the documentations. Too bad that I lost the opportunity.

Don't tell them about NBI or USEM or NVC or that stuff.

You have a GC and a SSN.

You might need to tell them that you are a new immigrant and that you have a new SSN. It is valid for work, obviously. If they tell you otherwise, then they are wrong.

Another thing to consider is that they might do a credit check on you. You will not yet have a credit score because you have not taken out any credit in the USA. They will have to understand that.

Ask them what kinds of checks they are doing.

Thank you! I told the most recent employer about that but didn't respond so I guess they just don't wanna deal with that. But I started applying again and whenever i get an interview i tell them what happened from the past job offers. But I will surely ask them next time what king of checks are they doing.

Don't tell them what happened with past job offers; that's not professional. Start fresh, each time. If they mention doing background checks, ask them which ones and go forth.

You are work authorized.

They are likely doing credit checks on you, not a background check.

Part of what you may need to do is open a new bank account.

But the other part is follow Harpa's advice. Do not bring up previous job offers and do not mention anything about background checks until they do.

Update regarding this issue. The reason they are getting invalid result when they try my name and my ssn is because USCIS had my name incorrect again for several times. I got 2 first names and middle name is my maiden name. They omit my 2nd name. Ex, my name is Jean Marie Santos Smith, They just put Jean as my first name and it should be Jean Marie. So I will have to go to a local USCIS to have it corrected.

That's awesome that you could find out the problem and really stupid that the USCIS was causing you not to get a job because they messed up.

Hey Thank you for empathizing. Yeah! They've got my name incorrect for a lot of timse. They denied us our case incorrectly and cause us too much stress and now they cost me 2 job offers. What else can I ask for! lol. We will have to go to the local office to correct their mistake and hopefully the companies will let me use the incomplete name for e-verify.

With regard to the person who mentioned software not being up to date - patches are released well ahead of the Social Security releases a new block of numbers - we've had patches for our various HR software to ensure we don't run into any problems

That is nice to know. What makes me wonder is how can the information in the e-verify has my incomplete name but SSA has it right. I even went to the local ssa office to correct my name last month since they got my name incorrectly on the first ss card i received. They had to verify it to the DHS and got my replacement card with the correct name. It's just crazy and really frustrating. I have to call too many people and redirect me to different dept. Even applying a bank account is hassle since they could not verify me.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
