Hi everyone,

Just wanted to know if there will be any discrepancy or if I need to worry about anything because since march 14, 2014 till today i haven't filed anything. My immigrant CR1 visa expired april 25, 2014, and my i-485 I'm filling it up to be passed this coming week.

My concerns and questions are:

i-94- Where to get it because i tried online and my records don't show.

CR1-visa has expired and i haven't filed my i-485. Is this okay? Is there a time limit?

$165 Fee for UCLIS- The packet which was delivered to my home back in the PHILIPPINES included a paper that i did not notice which advised

me to pay online via UCLIS the $165 fee for the Green Card or else they will not deliver it. I did not PAY for it because to my knowledge the i-485 which costs $1,080 w/biometrics is the fee for the green card. is that okay even if i didn't pay for the $165?

I received my SSS and DMV already and will start working soon. Is there anything I should be worried about regarding my status and the papers i need to file? I admit that me and my wife slacked off in the process of this upon my arrival because we traveled a lot and it only came to my head that I have to fix these things.

Hoping someone could enlighten me on this that understands my situation.

sorry, you are confused.

arriving on a CR-1 visa? the endorsement stamp in the passport, next to the visa page,

turns the CR-1 visa stamp into a 1 year temporary green card, an I-551 document (and says so on the visa page)

with validity dates from POE date to 1 year past that.

re: ELIS - want a green card? must to pay @ ELIS website and wait for the card to be produced and shipped to you. It's 165. No need to file I-485, a CR-1 visa holder not need this.

re: I-94 - CR-1 visa holders never, ever get this , nor have a need for it. The endorsement stamp done at the POE is sufficient.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

No filing of an I-485 ever, and no I-94 is given when you've entered using a CR1 or IR1 visa. You should have a green card by mail already. If you don't, you either moved, there has been a mistake by USCIS or you neglected to pay the new immigrant fee. Instructions for doing so, came in your visa package.

Facts are cheap...knowing how to use them is precious...

YES I AM SUPER CONFUSED GUYS! pls help me!

thanks for your comments =) I slacked a lot before leaving and slacked even more upon arriving because nothing else mattered but my wife. we missed each other soo much, 1 year and a half of not being physically together was harsh. anyway. to cut the story short. My wife and I filed this on our own without a lawyer and we were both busy working so hard to save money for our lives here. We hardly had any advice but my UNCLE's advice who has been telling us what to do next. Right now, he is telling me to pay $1,080 for adjustment of status. I really have to know what to do so I could move on and start working with peace of mind. Guys we are a young married couple. We really appreciate all your comments. Thanks and God bless!

1. Yes i wasn't able to pay the $165 fee.- Can i pay for this now?

2. What is the next step i should do?

3. Am i going to be penalized for this?

The only documents that the I.O left with me are the MEDICAL RESULTS (sealed) and my passport.The whole packet is with them already. Thats it. What's next? Thanks for your time. Really want this to be clear because my uncle is telling me to do otherwise and pay $1,080. I really hope It's just the $165. Also want to know where to pay the $165 in the United States if I haven't paid it before i left in the Philippines.

All of the information on where to pay the $165 immigrant visa fee is in your visa packet.

Pay the fee, ensure your address is correct in ELIS and your green card should appear in the mail within 60 days.

Definitely stop listening to your uncle, the advice that he is giving you is for a K1 visa and you have a CR1 visa.

Like everyone else said, pay the IV fee and wait for the greencard. I think ours last year ended up taking over 3 months to arrive so don't panic if you are over 60 days, but do call USCIS it is has been 3 months and you've yet to receive your physical greencard.

The CR1 visa and stamp nearby works as your greencard for the first year anyway (it expires one year from the date that was on the stamp at POE). If anyone disputes this have them google I-551, the technical name of your greencard.

Are you in the USA?

If so then go to http://www.uscis.gov/uscis-elis , make an account and pay the $165 immigrant fee. That will start the production of your green card.

When you arrived in the USA the CBP officer stamped your visa. With the stamp should be a date approximately 1 year from the day you arrived in the USA. That is your "temporary" green card which serves as a green card until you get the other one in the mail.

YOU ARE ALREADY A PERMANENT RESIDENT. DO NOT ADJUST YOUR STATUS.


If you have not arrived in the USA yet, then you can still go to that website and pay the $165 immigrant fee before you come.

Hi,

Yes i am in the U.S been trying to pay the 165 fee since last night but it doesn't want to continue to the last page of the process for payment information. Also i lost a piece of paper that was given to me together with my medical results from the Philippines. He told me to bring that upon being called for the interview of naturalization. Should i also be worried if I lost that? its just a small paper that says I have to file something within 90 days upon arrival or else.... I'm not so sure what that paper was about but if you guys could help me figure it out it would be helpful. Thanks!

that's 3 to 4 years later, not 3 months later.

re: online payment - get on a PC with Internet Explorer v7 8 or 9. The website was designed only to use that browser, so if you are using something else, is prone to errors and failures.

for a CR-1 visa - filing something within 90 days is not done.

re: medical results this year - does not matter, based on your VISA type.

If you are getting browser errors, find a computer with Internet Explorer installed and use that.

A 90 day space of time to do something after entering the USA is for a fiance visa case. Nothing like that applies to you. Pay the fee. Get the green card. 3 months before that green card expires, follow the "Removal of Conditions" guide here to get your next green card good for 10 years.

Stop listening to anybody telling you to do anything different than paying the fee you should have paid long ago.
