Hello Saylin,

Regarding AOS

My wife got permanent Job on SEP 2013 with an annual pay of $ 50,000. Hence 2013 tax transcripts show annual income of 11000 only (obviously pay accounted is SEP 2013 to DEC 2013). However, she has letter from employer clearly indicating her income of $ 50K. Also we will be sending her pay stubs from SEP 2013 till date (6 months).

Will this be fine?. I was afraid as her latest 2013 tax transcript shows $11000 as annual income. But this is obvious.

My two cents (although saylin would probably answer this better).

Your 2013 income is different from your current income.

It seems to me that she does have stable current income (paystubs and offer letter).

So you are good as far as Part 6 -> Section 5 is concerned -- on the i-864

But because come April 16, her 2013 income will become "income from last taxable year" -- that income must exceed $ 19500 or so, for a household size of 2

Your 2013 income - Part 6 -> Section 13 a will be $ 11000 -- on the i-864.

That maybe a problem.

Some consulates are not ok with that.

I know that Delhi, which scrutinizes everything to the most possible extent may not like this at all.

What did she make in 2012 and 2011 ?

if it exceeds the threshold for your household size, that can definitely help your case.

She can state that income on Part 6 -> Section 13 b and Section 13 c

You should STRONGLY consider getting a joint sponsor and having that form filled out and ready just in case you get some rude jerk CO who won't work with ya.

You shouldnt risk ending up with a 221g for AOS.

What I guess is they will also look at current income. What makes me think this is they have mentioned in instruction for I-864 that you can send other documents that can reflect your current income. So. But yes you are correct. There are ifs and buts here.... smile.png

Hi Saylin!

My wife came in Europe, Georgia, Tbilisi in April 13 of 2013 and after 3 month we got married, since her arrival we live together. Despite of short period must she (My petitioner) prove US domicile? (I have heard at another forums that if it is 1-2 year you don't need to prove domicile, but i am expecting confirmation form you anyways) Thanks

Hi! You may want to take another look at the second post in this thread. It explains everything you need and for what purpose. Basically, at NVC there are two major steps that need to happen: 1) the petitioner will submit an Affidavit of Support (AOS), demonstrating financial support of the beneficiary (I-864 is the AOS); and 2) the beneficiary applies for an Immigrant Visa (IV) (DS260 is the application). So, each one of these steps have a processing fee. These two fees will only be available after your case enters NVC's system and case numbers are assigned and after you file the DS-261 online (if you don't have a lawyer).

Different reps. from NVC told me the same thing the first calls I made inquiring about our I-129F, but when they knew our I-130 was also there they just said that they will make a decision regarding the I-129F. This one never left the NVC.

In case your I-129F gets to the embassy first, yes, you can choose not to pursue the K3. When you receive any instructions from the embassy related to the I-129F, you can just email or call them and let them know that you're processing the I-130 at NVC and that you don't want to apply for a K3 visa. They know how it works, so that shouldn't be a problem.

Our USCIS case numbers start with MSC (Missouri) but our NVC case numbers for I-129F and I-130 start with BGT (Bogota).

Hi! This process can be really complex and overwhelming at first. I don't know how many times I had to read it and write it down for myself to just get the overall picture! After I got the big picture, my approach has been to focus on each step at a time - I'm not a good multitasker :)
