K1 Visa, married, but now separated. (False Domestic Violence)

I notice a lot of Fil/West relationships are full of high hopes and expectations when the two don't really know each other. USA men get caught in the stereotype of every Filipina being the perfect wife. They can just go to a web site, pick one out and instant happiness. Filipinas often appear full of hollywood stereotype views of what life in America is like to. Every man is romantic and rich. They start chatting online, then fall in love with an idea in their head of who the other person is. They meet for a couple weeks, both in vacation and in love with being in love, and have no idea of the real person they're committing themselves to. Then they get together and living together finally get to know the person they just married. Sometimes it works and sometimes its a complete mess.

In 2012, over 5000 K1 visas were issued by the US Embassy in Manila, thats half of all of Asia, and more than all of Europe. There were 27,000 K-1's issued worldwide in the same year. With almost a quarter of all K-1s from one country, of course we're going to see more problems coming from that one country also.

Simply take a look at the right corner of vj homepage and see the Latest VJ Member Visa Approvals and Members interviewing today column. There is always one to three beneficiary from the Philippines everyday. So, of course!

Sorry buddy you got screwed. For the AOS even the removal of barriers there's an exception for victims of domestic violence. Your best bet would be to get a lawyer and fight everything. Once the AOS gets approved you will be on the hook for 10 years or until she obtains us citizenship. File for a divorce ASAP and have her served by a 3rd party.

every day of the week there is at least one case of a Filipino screwing over an american...at LEAST

I do humbly believed, whatever happens to them and to all others who experienced the same is NOT SOLELY attributable to the Filipinas. Remember the OP has already the "gut" feeling from the very beginning but still he pursued it.. I didn't say Filipinas are not in fault but scammers are everywhere, and not just Philippines and Nigeria.We should be REALISTIC..DO NOT IGNORE signs/warnings.

I think MOST of this fraud marriages happen to USC much older women married to a very young Nigerian men OR

USC much older men married to a very young Filipina women

Facts don't equal racism, despite you being all in a kerfluffle over them.

I personally hate reading sad stories such as what the OP had however, your previous comment is uncalled for. While Scam in visa do really exist, take note that it i not just a country specific. It happens anywhere from across the Globe. Your country is not even exempted from this kind of people.

seeign that I see a lot of stories about philippines here and almost none about Nigeria with regards to women using USC men almost on a daily basis to get green card,I would assume Philippines is wayyyyyyyyyyyyyyyyyyyyyyyyyyyyy above Nigeria but hey...lets beat up the poster boy of the past despite hardly ever coming across stories about Nigeria or Nigerians on here

Having spoken to my lawyer this morning, I casually mentioned this thread to him. He said that the USCIS would welcome him to come and meet with an official at the closest Homeland Security office. Seeing that you're from Kansas City, it will be the one on NW Conant Avenue in KC. It is the same one I went to and the officials there are very friendly. I hope this helps! I am sorry that you are going through this. I can only imagine how terrible this must be for you and your family. I hope she gets sent back to her home country soon, too. Keep us updated!

Now, not meaning to stray from the subject, but I felt I need to address this kerfuffle that Avery Cates said I was going in to. Generalizing that all people from one country or another is not what I expected from someone on this helpful website. We are ALL from various parts of the world and saying things that cover an entire people from say the Philippines or Nigeria is uncalled for. What happened to respect? Have you forgotten where you are posting? All you need to do is read here the many success stories of people from around the world wanting what you and I and everyone on VJ want: Life, liberty and the pursuit of happiness in the United States. Maybe you're into the whole nationality shaming, so be it. You are entitled as much as anyone else with your opinion but none of that makes it easier on the original poster or the people here trying to help him with vital information.

I have a lady Mary Grace who I got married from the Philippines who I sponsored on a K-1 Visa, but then took off on me right after I filed for an AOS and placed a false domestic violence claim against me from the local PD in Kansas City. There was no injuries on her, and I am in the process of getting the case dismissed w/diversion. I got wind she did this to get a U-Visa to basically "take-off" and stay in the USA. She made all these crazy allegations that were untrue, and I think she deliberately staged the whole thing.

We had a yelling match but that was all mostly because I was tired of being asked about the paperwork 24/7 and asked to send money back to the Philippines. Then the cops show up, and Im thrown to the ground, and beaten up, taken outside and arrested, with 4 assault rifles at my head, being told "if you move your head will splat on that pavement" They had broken into the apartment, simply because I didn't hear them outside.. I had no idea what was going on until I was literally on the floor after hearing my front door go down. At that time we had long finished our argument.

Seriously with no injures on her, or me, and nothing broken or physical happening.... I have no criminal record...

I am out thousands of dollars, and going through hell dealing with this, and now she was all "I still love you" for a couple of weeks after I got out of Jail. We both got evicted, so she stayed with her cousin in Kansas City, and I stayed in a hotel for a bit to figure out living arrangements etc... until I discovered she contacted an immigration attorney (seen it on my phone bill) a couple of days after a few thousand texts were being sent to a guy by the name of "mike" She suddenly cut me off and disappeared. I am assuming she got info about the U-Visa. I then went back to Arizona (w/family)

The entire time, I had that "gut" feeling she was only using me to get into the USA and the marriage was fake.. Because I caught her messaging several other guys while in the phillipines asking then for visas from UK and the USA. How stupid I was...

She has shacked up with a new BF already, and I am getting ready to file for divorce.. But I am afraid because of the affidavit of support. Its all confusing, and stressful. I don't want any ties with her at all any more.

I am so frustrated and after the police thing, have a case for police brutality, but honestly I have been victimized by her fraud, police brutality, and falsified charges (getting dismissed).. I never thought this could never happen in America..

Now I am in the process of immigrating overseas myself after this senario, because I don't trust the government anymore. I was told she could tap into my bank accounts using this U-visa etc by an attorney and will likely try to.

Should it be any coincidence caryh that annual VAWA filings are now over 10,000? Does anyone here really think that there is that high an incidence of violence in immigrant marriages? It would be interesting to see what the nationality stats are for VAWA, but I don't think we'll ever see those numbers.

It is no mystery around the globe that an I-360 is a "get out of removal proceedings free" card. This poor guy is on the hook for a lot of money both from his marriage and his criminal defense. I'm lucky in comparison. It only cost me $100K with no criminal defense, no alimony, no child support, and no I-864 money going to my ex con-artist wife.

Our taxpayer dollars should be spent on proven incidents and austere programs of domestic violence. Not on this immigration loophole with a high fraud rate. Just my opinion but we see more and more and more cases of this on VJ and now that 90 day fiance' is on the air. Regardless of age span, national origin, religion etc. we should not be chasting vicitms and OP's for their choices, but our government should be doing a better job of WARNING K-1 applicants and a far better job of detecting and enforcing penalties against fraudsters. Then the number of false claims would fall dramatically.

I have bad news for the OP here though, yelling and screaming at your spouse in most states is considered "extreme cruelty" believe it or not in VAWA's eyes and his beneficiary will most certainly suffer PTSD and depression as a result. Hello free ride to being an LPR!!! Congratulations another successful scam.

Just a question...does USCIS care if she's quickly moved in with some other guy? Do they weigh the case considering things like that?

I would tell poster to keep notes and records...dates and times with everything that has occurred and happens in the future with your ex.

sandranj's real world experience with VAWA and fraud is invaluable to the VJ community. Her heart and soul is in assisting true victims of domestic violence. She also can obviously sniff out a lot of fraud as well. From my experience with patients and at USCIS myself I'd be willing to guess at 5 or more countries right off the bat.

Philippines

Nigeria

Russia

Vietnam

China

I'd bet there are plenty from Ghana, India, Pakistan, Cambodia, Romania, and many other countries with repressive societies. Cultures where lying to survive and/or get ahead is common would be a natural stepping stone to romance fraud for immigration purposes.

In your first paragraph you say you are in the process if getting the case dismissed W/diversion. Do you have an attorney involved in this? You know that basically a diversion program is designed for first offenders to serve a sentence/fine/community service etc., without pleading guilty. You are basically saying you did it but the charges may be dismissed if you complete the program.

I would never do this without understanding all the ramifications, and having the advice of a good attorney. Maybe you misspoke?

"diversion n. in criminal procedure, a system for giving a chance for a first time criminal defendant in lesser crimes to perform community service, make restitution for damage due to the crime, obtain treatment for alcohol or drug problems and/or counseling for antisocial or mentally unstable conduct. If the defendant cooperates and the diversion results in progress, the charges eventually may be dismissed".
