6 months after AOS interview and now: Surprise! immigration officer knock knock on my door...I was not expecting that! it was yesterda in the morning and I was in Pijamas and my husband was sleeping..

My husband and I have been married for 2 years and half., three years living together in total 5 years and a half. bank account together, apartment lease together, we bought a truck together..and much more receipts together.. Why on earth do they think our marriage is not Bona Fide!

What to expect next? I don't know..

Some advice would be greatly appreciated.

They are doing their job trying to weed out the fakers. If you got proof that your marriage is real, then you got nothing to worry about.

As far as advice, be honest with them so they would not question too much and go away quicker.


And you have enough proof so there áre really nothing to worry about and pray that they disappear from your life for good.

I think you were pegged because of the time between you entering the USA and the date of filing the AOS package and the type of visa you used to enter the USA.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Yes, it took like 15 minutes. He asked a couple of questions and wanted to see the bedrooms my husband showed him and then he said goodbye with a handshake and left.

What really concerns me is the long wait.

I think you were pegged because of the time between you entering the USA and the date of filing the AOS package and the type of visa you used to enter the USA. I did not think of that.

May be the type of visa. Because a friend of mine entered with a tourist visa. She overstayed and has been here for more than ten years. She mail the package in February this year and she received her GC in november 15th. 9 months in total.

By your timeline, and the fact that you filed the I-130 along with your I-485, I am going to assume you did not enter the US with a family based visa, but a tourist visa?

I honestly don't know why anybody who has a genuine marriage would have a problem with this. If there is nothing to hide, then I say "bring 'em!" It would give me a chance to prove that my marriage isn't fake, in person. Makes my job and their job easier.

H2B visa. I met my husband here in USA. Three years later we got married. and after that, we waited almost to years to file I-130 and 1-485 concurrently.

I'm being patient waiting.

Interview went well. We answered all the question. The only thing that concerned the officer is the fact that we don't have children. She asked me why we don't have kids, I answered that we are trying.

She did not approved, just handed my husband a paper explaining that our case is being held for review and that uscis does not require any further information or documents from us and that we would receive a notice in the mail. I have called twice. and received a notice that the case is pending adjudication.

#######?? who cares if you have children yet or not?? Any officer coming to my door 2-3-10 yrs down the road will be very unimpressed with us, cause I can't have kids anymore...that is soo irrelevant!!

Btw, glad they ARE doing their job to weed out the fakes, sorry it had to be you, but hey least now they know, and can put your case to "rest" :)

This seems so wrong and against personal decisions...I just had a newborn and then found out I have a genetic heart condition and have decided it is not worth it to risk having further children since they could end up with the same heart condition...My point is - its a personal decision that is best for you...I would have probably not taken that question lightly, and I'm sorry you've had to deal with that. That is just ridiculous.

Personal questions are common in interviews, and it is nothing to get upset about. The OP has the right to choose not to have children. It is not a problem. They just want to gauge her reaction in answering that question.

OP: They found you both at home sleeping, so I would expect an approval soon. Good luck.

Well it's about time! I don't mean you are doing anything wrong but it appears that the government might actually be doing there job. Imagine that!

Entered on a non-immigrant visa from a country with a high rate of immigration to the US, overstayed and later filed for adjustment of status based on marriage. No kids. They probably just wanted to make sure.

They got their answer when you were both sleeping under the same ceiling. As Harpa said, expect an approval soon.
