( K1 approved) petitoner is On SSDI and depressed, 2012 Earnings only $15K but 2013 $20k!

Not for me, this is for the guy I know Please suggest what to do!

His k1 just got approved last month. The girl has 2 kids but planning them FOLLOW-TO-JOIN later since his earning is not qualified for 4 household. His plan to bring his fiancee only. But here's the real problem that he is depressed about.

He is on SSDI and his earning last year 2012 doest not look promising. (TAX 2012 only $15K).

Although, his 2013 he said he is speculating to be making $20k.

He plans to delay the interview next year until he files the tax 2013 that way he can be qualified for poverty guidelines.

He is worried that he might not get approved because his last 2 years earnings were only around $15k.

Will this cause problem even tho his recent income 2013 is at least just above poverty guidelines for just his fiancee $20K.

What do you think guys?

Shall we go ahead and have interview now with 2012 income only $15k

or wait file 2013 tax (speculation earnings is at least $20k in 2013) first then continue the interview next year?

Manila US Embassy does not accept Joint sponsor. I heard it might be case to case basis.

Not listing the kids to follow to join. To shaky. He needs a co-sponsor. And Manilla is very hard on K1's and co-sponsors.

every year the poverty guidelines income goes up so next year you don't know what that income level is going to be.

So what's the best choice for him now?

So no bright possibilities that he would be approved?

They are thinking if she get approved, she come to US first, then work asap, get their income stabilize together then petiton for 2 kids later.

So if he can find a co-sponsor, should he try to fill up form 864/a just in case they will ask for co-sponsor?

I know that it is case to case basis. What shall he do?

NO not really. He has rental income but it does not show as his cuz the rental property is in his father's name.

So I dont think that's count.


What is his current income?

no he is making $1040/month on SSDI, but i think he is working part time. Not sure how he ads the number.

That's low even for two people. I hate to be the bearer of bad news but in all likelyhood the embassy will take one look at the income and deny the visa.

I think your best bet is going to be to get a co-sponsor, and hope they accept it.
