Well I guess it's offical now.. My husband was just contacted by the Kingston Embassy who informed him.. Our joint sponsor did not get accepted.. Here is what I know I meet the poverty Level. as well as my joint sponsor. We have had 2 interviews on the second one He was advised I did not meet the criteira even though I make well over the poverty Limit..

My husband has just informed me that he received a call from the Kingston Embassy and have been advised that the another sponsor has not been accepted. My father does indeed meet the criteria outlined by USCIS shows that a household size 2 income criteria is 19,387. His IRS statements show his income as 24,784.92.

The initial interview it was deemed that I did not meet the criteria 2010 household size of (3) with income for this year of 25,368.00 according to the property guidelines requires it not be less than 24,412.00. The income reduction for 2010 was due to having to take a 15% pay cut.

In 2011 my reported income was 43,477 carrying the same 2 dependents and myself making it again (3) the guidelines shows that I would need a income of 24,412. . I as well qualify to sponsor my husband without the joint sponsorship. My stepson was also per my husband not acceptable to be considered a household sponsor even though we all meet the guidelines with USCIS. And in 2012 due to a accident I claimed my stepson whom I also attempted to use his income for 2012 as a household sponsor which were at my husband 2nd Interview but was not accepted just stating he did not qualify. A income of 45,706 income level is for household size of 7. We meet the property guidelines yet we have been informed were are denied do to not meeting the poverty guidelines. Please assist me with understanding why we are being denied.

What can I do? Is there somekind of appeal I can do? How can they deny us? Please help is there something I can do?

if this is considered a 221(g) denial then kingston should be giving him something in writing. did you try contacting the Department of State to see what the denial reason is. The DOS should be able to advise you about any recourse if available.

if he was just 'contacted' then I will guess that the visa application is not dead,

and you're given another chance to source out a joint-sponser that meets the requirements and submit back to the IV Unit. If I were in yer shoes, I'd go fast, to make that happen, this week.

I don't have anyone else to use.. Per the lawyer I had I more than meet the poverty guidelines on my own.. And should have never been asked for a joint sponsor..And my father meets the poverty guidlines too.. I just don't understand.. Why!! We have been going thru this process for over 2 years..I am at the end of my rope..

What does your income after deductions say, I think it is line 22 on 1040. Does that meet the income guidelines

Income after deduction would be adjusted gross income. They want Total income before adjustment.

I never said that I had a household of 7... Real talk the statement is that my income meets the requirement of having 7 dependents.. So with 45,000 gross income, and 43,000 last year I more than meet the poverty guidelines for 3 plus my husband is 4.. Per DOS the consular has the say so.. So the person over my case feel like even though me, the second sponsor who they are making the sponsor period as my income is not being used.. Nor the household sponsor that lived with me in 2012..

Non of it makes any sense...just Cruel folks

many embassies look at Current income and last years. But the big question is what kind of income is this?

SSI, Child support, 401K some embassies are funny about that?

And also could there maybe be some confusion since you said you claimed stepson in 2012 and tried to use his income. I don't know how you used his income but that could be something also.

If you make a senatorial inquiry you may get a more detailed idea of what exactly they are looking for.

Sometimes they are more specific through a liason rather than you trying to guess what they do or do not want.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

So confusing, you said you have 2 dependents, that makes it total of 3(+you) households members plus your husband that you petition that will total 4 household members. So you have to make $29, 347 to qualify for 4 household members. You also mention that you attempted to use your stepson income? (You can not use anyone income. Unless he is a co-sponsoring!) ?

EXPLAIN.......

IR5 DAD's Journey Total of 1 year from mailing out form I-130

(Jan 2013) to Visa in hand(Jan 2014).

02/02/2014: Paid $165 at ELIS site

03/06/2014: PORT-OF-Entry=Vancouver Canada

03/31/2014: USCIS Status Address Change

04/03/2014: Applied for SS

​04/03/2014: ELIS STATUS showed OPTIMIZED right away the day we applied for SS card.

04/07/2014: Green Card Production

04/09/2014: SS Card received.

4/10/2014: ELIS and USCIS status: GREEN CARD PRODUCED/SHIPPED

4/15/2014: GC arrived in the mail (yay!)

Did you claim your step son on your taxes or did you just try to use his income to help you meet the income level. If you tried to use his income to help you meet the income level he needed to fill out form I-864A and he must be living with you at the same resident address. If you tried to use his income alone he should have just used the I-864 as a co-sponsor. If you need help you should give a better explanation as members of VJ can assist you with valuable advice. Remember they look at your current income situation.

If you income is fine and you lawyer told you is find try to find the truth of why they denied because some time embassy dont tell the truth about why they denied you should contact you congress man they will give the congressman more info.... Good luck
