personally I would have my love one parked at the airline managers office and husband needs to contact POE and they can advise. this is a first so please keep us up to date.

Okay I get your point now.

I think she'll be able to board since she has a visa.

she can catch the flight but immigration wont let her enter to the States without the package. She cannot take this flight, instead wait for a response of the embassy

You are correct there Gowon. Airline will let her board because of the visa in her passport. Its all they check, 90% of them don't know that she needs the packet to be admitted into the US. But then again, its not their responsibility to make sure she does.

OP, my opinion, don't risk it. Speak to the airline and explain the situation of the stolen bag and how important the package is to be allowed into the US. Airline might waive all fees for the date change. I work for a major airline and we waive payment when we have a passenger that has lost a passport or has a passport stolen.

Only thing you should make sure is that your fiancee has a police report for the theft, show that to the airline and work from there.

I've never heard of someone entering the country with a k1 visa without her package. Is SO important that if you open your package before arriving to the POE you can get deported or not allow to enter to the States (when I went to my k1 interview the CO explained the importance of taking care well of my lk1 package and the things that might happen if I lose it or opened it). Yikes. I pray the police at the airport have recovered it by now.

As for travelling and transit -

1. she can get on the plane in her country.

2. she can get on other planes not in the usa for transit and layovers

3. she can land inside the plane where the USA POE is .

4. she will be stuck at the POE, as the handover of the visa packet is required for entry into the USA. HOWEVER - is quite possible the CBP fellas will let her through, if she has a police report from the first airport police office in her hand.

I've read of other folks with similar problem, but it wasn't that the visa packet was stolen - it was that a K-2 entrant 's visa file was with the K-1 visa file that came through a POE 3 months prior to the K-2, so there wasn't any visa packet to hand over. The K-2 was allowed in, but was really messy. In the end, an electronic record of the A-file, sans medical stuff, was able to be accessed and a paper A-file recreated.

I think it's a gamble, either way, either to remain in her country and beg the US Embassy to help recreate the A-File before travelling again oor come into the USA without the visa packet.

I dont think I agree with you. When I came here with my k1 the first thing the officer asked me when he saw my k1 visa, was my package. They have define procedure for every kind of visa. I've never heard of someone entering the country with a k1 visa without her package. Is SO important that if you open your package before arriving to the POE you can get deported or not allow to enter to the States (when I went to my k1 interview the CO explained the importance of taking care well of my lk1 package and the things that might happen if I lose it or opened it). She is en route to LAX. Embassy, uscis, and cbp seem positive she will be able to at least enter on a parole status but until she's through nothing is definite. Berlin officials were being very helpful but until she gets there we will not know. Will up date with status when we find out

I think you misread what I wrote. I was not talking about the CBO when his fiancee arrives at the POE in the US. I was talking about the airline check in agent. The check in agent won't check if the fiancee is carrying the packet. What they will check is the visa in the fiancee's passport to see if its valid. If its valid, she will be permitted to travel to the US. It is the passenger's responsibility to make sure they have everything they need to be permitted entry into the US.

It is why I advised the OP to speak to the airline about changing the dates of her flight till she has another copy of the K1 package in her hands or the old one if found.

Good job good.gif I think this was the best decision. The flight is already paid for and most airlines make refunds/switching dates a really big hassle so staying behind would have been a waste. Its better to just go and hope they are understanding, her visa was approved after all. InshaAllah everything works out for you both!

USCIS I-130 Petition for Spouse

September 2012: Filed from abroad to Chicago Lockbox

4 days later: NOA1, Routed to California Service Center

7 days later: Transferred because of new jurisdiction

5 days later: Case Status changed to: Under processing at USCIS office

NOA2 arrived 78 days after NOA1 :)

*I-130 Approval Notice hardcopy finally received in Pakistan, the only notice that arrived.

They do instruct ppl NOT to pack this package in any luggage

it should be in your handbag/carry-on....she will make it on

to the plane with her visa, however she will spend a lot of

time at the poe sorting things out....all this stuff is being

sorted already by them transmitting to pertinent agencies once

the matter were reported....Sorry for this, it will be a delay

& probably a very long poe processing, goodluck
